Nadir, during a telephone interview on Monday, said that the findings of the report were presented to the ITUC, by its affiliated member the Guyana Trades Union Congress, (GTUC) which had as its agenda the intention to “embarrass the country and the government.” He accused the ITUC of failing to do proper research and for depending heavily on the views of the GTUC. He said the fact that the ITUC did not attempt to get the views of the government, revealed their true aim.
The report, which was issued last week, said that although Guyana had “ratified all eight core International Labour Organization (ILO) conventions” the government has not done enough to implement these agreements.
The document addressed in detail issues related to “Freedom of Association and the Right to Collective Bargaining”, “Discrimina-tion and Equal Remuneration”, “Child Labour” and “Forced Labour”.
According to the report “forced labour exists in the form of forced prostitution and in logging camps and mines. The state agencies and the law enforcers do little to address forced labour and trafficking.” The report stated that “the government’s efforts to cope with child labour and enforce compulsory education are inadequate given that the problem concerns at least one fifth of Guyanese children.
Many children are engaged in hazardous work and child prostitution is recognised as one of Guyana’s worst forms of child labour. The law on child labour is not enforced effectively.”
The report said “Child labour in informal activities is a serious problem, and very young children are engaged in street vending. Apart from street vendors children are usually found as porters, domestic servants, wait staff in bars and restaurants and vendors in shops. There are reports of children found working in mining, logging, farming, fishing, and manufacturing industries doing possibly hazardous work and conducting illicit drug trade and prostitution. (A) UNICEF survey estimates that 3 percent of the children are involved in commercial sexual activity.”
The report also said that “several studies identified child prostitution as one of the worst forms of child labour in Guyana. For example a 1996 UNICEF survey answered by pupils revealed that 26% and 17% of the respondents knew female and male students respectively who accepted returns in exchange for sexual favours. The study concluded that there is an alarming degree of prostitution within the Guyanese secondary school system.”
Nadir, although acknowledging that there are cases of child labour in the country, emphasised that this was not the norm. Consequently, he argued that the country had been unfairly categorized. He said that other entities have come here and have not made such discoveries. He identified a report released by US-funded programme EDUCARE as one which disputed the findings of the ITUC.
He also vehemently denied that there was widespread prostitution among children as a section of the report contended, and said that the government has undertaken several initiatives to counteract such practices especially through a strong educational campaign. He said that there may be the occasional odd cases but that this could not be said to be a widespread phenomenon.
Nadir also refuted arguments in the report which said that “there are reports that anti-union discrimination laws are not applied and private companies have dismissed strikers.” He rebuffed suggestions that private companies have dismissed strikers and said that his Ministry has investigated every case of unfair dismissal that had been reported.
He again argued that while there may be a few cases of persons being unfairly dismissed, this was not the norm. He said that his Ministry had also been collecting money for employees who had been wrongfully dismissed by their employees. He said that for this year his ministry has collected close to $19 million, for such persons.
Additionally, Nadir objected to a part of the report which stated that “the listing of essential services, includes services which are not essential in the strict sense of the term; for such services the Minister of Labour can order compulsory arbitration and impose heavy penalties on strikers who participate in illegal strikes.”
According to the Minister, the report gives the impression that some recent laws that were passed set out to target workers and punish them but said that all it did was to ensure accountability from both sides. He said that the workers had to report to the Ministry when they wanted to strike while the employers had to report to the Ministry when they wanted to terminate the services of employees.
Nadir said the government has made significant strides, particularly over the last three years, in advancing the rights of workers.
He said that the effectiveness of the efforts of the Ministry had been recognised by workers themselves, since he said there has been an increase of workers who have been lodging official complaints with the ministry. This, he stated, has resulted in more prosecutions being done by his ministry. He also said that inspectors had increased their inspections of workplaces significantly.
Criticising the GTUC, the Labour Minister said that the body “had lost its right as the sole voice to speak for all organized labour unions in the country” even as he pointed out that the Federation of Independent Trades Union of Guyana (FITUG) had more members than the GTUC.
Meanwhile, Nadir questioned the timing of the report, as he said that it was released last week Wednesday, the same day when he was leading a team that was in Geneva, Switzerland, as the World Trade Organization (WTO) conducted a review of Guyana’s trade policies and practices, in keeping with the international requirements. The Minister, however, stated that no official from the WTO questioned him about any part of the report while he was in Geneva.
The ITUC represents 170 million workers in 312 affiliated national organisations from 157 countries.
According to the ITUC website, “the body’s primary mission is the promotion and defence of workers’ rights and interests, through international cooperation between trade unions, global campaigning and advocacy within the major global institutions”. The Programme Document adopted at the ITUC founding Congress sets out the Confederation’s overall policy framework, which builds on existing ICFTU and WCL policies. Its main areas of activity include: trade union and human rights, the economy, society and the workplace, equality and non-discrimination and international solidarity. (Mark McGowan)

on another issue. Minister Nadir said that he had intended to charge the security company that was providing services at Clico for illegally terminating their employees contracts. I cannot remember the name of the company. but soon after Nadir made public his intentions, we learnt that Clico CEO Geeta Singh-Knights was a director at the said company along with the driver of Clico owner Duprey. we also learnt that Knights had authorized millions in payment to the said company (her company).
soon after Nadir went silent on his intention to charge the owner of the company. the employees are still without their jobs and the necessary benefits.
Can Nadir update us on the status of the charges?

How come when anyone raises an issue of concern their main goals are to “embarrass the country and the government.”?
Seriously does the PPP really believe they are mother teresa or something and they are somehow excluded from criticism?
This is a real issue, Nadir come on you are one of the smarter ones in that cabal get your act together and stop poo poo pooing. Go back to your laptop reading in parliament.

Gandhinagar: Former Gujarat chief minister Suresh Mehta today said the GT Nanavati commission of inquiry must allow chief minister Narendra Modi to be cross-examined on his role in the post-Godhra riots of 2002.

An application filed by a non-governmental organisation, Jansangarsh Manch, to cross-examine Modi in connection with the Gujarat riots is pending with the commission set up to probe the Godhra train carnage of February 27, 2002, and the riots that followed.
Mehta, who quit the Bharatiya Janata Party before the state assembly elections of 2007 following differences with Modi, said the two-member inquiry commission was set up by the state government headed by Modi himself to find out the truth behind the communal violence of 2002, which claimed over 1,200 lives.
"The inquiry commission was constituted by the government to find out the truth. Now, Modi's cross-examination will help the commission to get at the truth of the riots," he said. "It must be allowed and the CM should depose and be cross-examined before the commission.
"I fail to understand why the chief minister is hesitant to undergo cross-examination before the commission," he continued. "This is very important for the state of Gujarat. If I were in his place, I would have offered to undergo a narco[-analysis] test."
The state government in its affidavit filed with the commission headed by retired Supreme Court judge GT Nanavati questioned the bona fides of the Jansagharsh Manch's application, accusing the NGO of making incorrect statements in the past and trying to distort the truth.

દારૃ-લઠ્ઠાના ગુનેગારોને ફાંસી

અમદાવાદમાં સર્જાયેલા લઠ્ઠાકાંડના પગલે ગુજરાતના પ્રધાનમંડળે હાલના ‘મુંબઇ નશાબંધી (ગુજરાત સુધારા) કાયદામાં વધુ સુધારો કરીને દારૃ અને લઠ્ઠાના ગુનેગારોને ફાંસીની સજા કરવાની અભૂતપૂર્વ જોગવાઇ કરતું એક બિલ આજે મંજૂર કર્યું છે. આ બિલ વિધાનસભાના ચાલુ સત્રમાં જ સરકાર ચર્ચા માટે ગૃહમાં રજૂ કરનાર છે.
આજે મુખ્યમંત્રી નરેન્દ્ર મોદીની અધ્યક્ષતામાં મળેલી મંત્રીમંડળની બેઠકમાં લઠ્ઠાકાંડના મુદ્દે ચર્ચા કરવામાં આવી હતી અને મોદીની સૂચનાને પગલે કાયદા વિભાગે વર્તમાન નશાબંધી કાયદામાં રહેલી ક્ષતિઓ દૂર કરવા તેમજ સમગ્ર કાયદાને વધુ શક્તિશાળી બનાવવા માટે સુધારા વિધેયક તૈયાર કરાયું હતું તેની ચર્ચા વિચારણા કરીને મંજૂર કરવામાં આવ્યું હતું. સૂચિત બિલ હવે નશાબંધી કાયદા (ગુજરાત સુધારા) વિધેયક, ૨૦૦૯ તરીકે આજે વિધાનસભા સચિવાલયને ગૃહમાં દાખલ કરવા માટે મોકલી આપવામાં આવ્યું છે. સરકારનંુ માનવું છે કે અગાઉ ૧૯૯૭ સુધીમાં ૨૫ લઠ્ઠાકાંડમાં ૩૫૪ વ્યક્તિઓએ જાન ગુમાવ્યા છે અને ઘણા કિસ્સામાં તપાસ પંચ પછી પણ કોઇ નક્કર કાર્યવાહી થઇ ન હોવાથી હવે કાયદામાં પણ સુધારા કરી આકરી જોગવાઇ કરવી આવશ્યક જણાઇ છે. અગાઉ પણ મિથેનોલ જેવા કેમિકલથી બનાવાતા ઝેરી દેશી શરાબ પીવાથી આવા લઠ્ઠાકાંડ સર્જાયા હતા અને આજે પણ અમદાવાદમાં આ જ રીતે બનેલા લઠ્ઠાએ અનેક લોકોના જાન લીધા છે. સૂચિત બિલની જોગવાઇઓ મુજબ દારૃ અને લઠ્ઠાના ગુનેગારોને ફાંસીની સજાને પાત્ર થાય તેવા સુધારા કરવામાં આવ્યા છે. આની સાથોસાથ, નશાબંધીના કાનૂનના અમલ માટે નિષ્કાળજી દાખવનાર પોલીસ અધિકારીઓને પણ એક વર્ષ સુધીની જેલની સજા થાય તેવી આકરી જોગવાઇ પણ સૂચવાઇ છે. સમગ્ર દેશમાં લઠ્ઠા કે દારૃના ગુનેગારો સામે મૃત્યુ દંડ કે આજીવન કેદની સજા જેવા સખ્ત જોગવાઇવાળો કાયદો હાલ અસ્તીત્વમાં નથી. આ બિલમાં લઠ્ઠાની વ્યાખ્યા કરવામાં આવી છે. કલમ ૨૩ક પ્રમાણે લઠ્ઠો એટલે એવો બનાવટી દારૃ જેમાં, મિથેનોલ હોય અથવા માનવ શરીરને નુકસાનકારક અથવા હાનિકારક અસરો થાય તેવો અથવા જેનાથી વ્યક્તિનું મૃત્યુ નીપજે તેવો બીજો કોઇ પણ ઝેરી પદાર્થ હોય.
•ભૂતકાળમાં ૨૫ લઠ્ઠાકાંડમાં ૩૫૪ લોકોએ જાન ગુમાવ્યા છતાં નક્કર પગલાં લેવાયાં નથીઆ ઉપરાંત સન ૧૯૪૯ના મુંબઇના ૨૫મા અધિનિયમમાં નવી કલમ ૬૫-ક ઉમેરવા માટેની જોગવાઇ કરવામાં આવી છે અને આ જોગવાઇમાં જે કોઇ વ્યક્તિ એટલે કે લઠ્ઠાનું ઉત્પાદન કરતી હોય, દારૃ ગાળવાની ભઠ્ઠી અથવા દારૃ બનાવવાની ભઠ્ઠી માટેનું કોઇ બાંધકામ અથવા કોઇ કામ કરતી હોય, લઠ્ઠાનું વેચાણ કરતી હોય અથવા તેની ખરીદી કરતી હોય અથવા લઠ્ઠો વાપરતી હોય, રાખતી હોય, હેરફેર કરતી હોય અથવા પોતાના કબજામાં રાખતી હોય તેને દોષિત ઠર્યેથી, દસ વર્ષ સુધની, પરંતુ સાત વર્ષથી ઓછી ન હોય તેટલી મુદત સુધીની કેદની અને દંડની પણ શિક્ષા થશે. આમ, દારૃ બનાવનારા, દારૃની હેરફેર કરનારા, સંગ્રહ કરનારા, દારૃનું વેચાણ કરનારા અને લઠ્ઠાનો સંગ્રહ કરનારા ગુનેગારોને આકરી સજાની જોગવાઇ ઉમેરાશે.
કલમ ૬૫-કની પેટા કલમ (૧)માં ઉલ્લેખેલા લઠ્ઠાના ઉપયોગથી કોઇપણ વ્યક્તિનું મૃત્યુ નીપજે તો, જે વ્યક્તિએ લઠ્ઠાનું ઉત્પાદન કરેલુ હોય, રાખેલો હોય, તેનું વેચાણ કરેલું હોય અથવા તે પીવાની અથવા વિતરણની વ્યવસ્થા કરેલી હોય તેને, દોષિત ઠર્યેથી મૃત્યુ દંડ અથવા આજીવન કેદની અને દંડની શિક્ષાને પાત્ર થશે. આમ, બુટલેગર્સને હવે મૃત્યુ દંડથી આજીવન કેદની સજા થઇ શકશે. આ જ રીતે નવી કલમ ૯૪ ક દ્વારા સરકારે જે પોલીસ અધિકારીઓ અને નશાબંધી વિભાગના અધિકારીઓ આ કાયદાના અમલમાં નિષ્કળજી દાખવવા માટે જવાબદાર ઠરશે તેની સામે કાનૂની ગનો દાખલ કરીને તેઓ સામે કેસ પણ ચલાવાશે અને એક વર્ષ સુધીની જેલની સજાને પાત્ર ઠરાવાયા છે. એટલું જ નહીં કલમ ૯૮માં સુધારો કરીને સરકારે એવી પણ જોગવાઇ કરાઇ છે કે આવા અધિકારીઓ કોર્ટના આખરી ચુકાદા સુધી વાહનો, સાધનો વગેરેને બોન્ડ અથવા જામીન પર મુક્ત કરી શકાશે નહીં.
આ ઉપરાંત લઠ્ઠો કે દારૃ વગેરે નિયત કરેલી મર્યાદા ઉપરાંતના જથ્થાની હેરાફેરી, પરિવહન માટે વપરાશમાં લેવાના તમામ પ્રકારના વાહનો, સાધનો વગેરે સરકારી સંપત્તિ તરીકે જપ્ત કરી લેવાને પાત્ર બનશે. સૂચિત સુધારામાં આ પ્રકારે પકડાયેલા દારૃ, લઠ્ઠા વગેરેના નમૂના ફોરેન્સીક સાયન્સ લેબોરેટરીમાં મોકલવાનું ફરજિયાત બનશે.
સૂચિત સુધારા
•ગુનેગાર માટે આજીવન કેદથી મૃત્યુ દંડ સુધીની આકરી સજા
•દારૃ-લઠ્ઠો બનાવનાર, હેરાફેરી, સંગ્રહ, વેચાણ કરનારને દસ વર્ષ તેમજ આવો જથ્થો પૂરો પાડનાર બુટલેગર્સને આજીવન કેદથી મૃત્યુ દંડ સુધીની સજા.
•વાહનો, સાધનોને સરકારી મિલકત ગણીને જપ્ત કરાશે.
