Sub: - High rate of interest paid to DoT towards loan of Rs.7500/- crore.
Sir,
It is seen that the BSNL has paid interest @14.5% for the so called loan of Rs.7500/- crore to DoT
and also default penal interest @2.75% as also prepayment charge @0.5% in case of repayment of
installment in advance. It is understood that an amount of Rs.3200/- crore has already been paid as
interest towards the assumed loan of Rs.7500/-crore.
Already much loss has incurred in this connection. We would like to know what action has been
taken in the following matters.
1. Whether the management has consented to the claim of DoT that Rs.7500/- crore
have been given to BSNL, while no amount was paid as such?
2. Assuming that a loan of Rs.7500/- crore is accepted by BSNL, why there was delay
in refund of the same, when there was sufficient cash reserve with the BSNL to the extend of
Rs.35,000/- crore.
3. Why there was delay in payment of interest resulting in penal interest, when there
was sufficient funds with BSNL?
4. Whether BSNL has pointed out the high rate of interest to DoT and if so, what was
the justification given by DoT?
5. What is the justification for DoT to claim additional interest on prepayment of loan?
6. Since in addition to the assumed loan of Rs.7500/- crore an interest of Rs.3200/-
paid to DoT has resulted in a net loss to BSNL. Whether the BSNL management has enquired
in to this matter and if so what are the findings?
In order to have transparency and saving the valuable funds of BSNL necessary immediate action
be taken in the matter. The union may be appraised of the position also.

Sub: - Austerity measures in BSNL to reduce unnecessary expenditure

Sir,
Kindly refer to our letter cited above in which we had pointed out several areas where the
unnecessary expenditure can be reduced and austerity measures ensured.
We are happy to note that you have issued instructions to reduce expenditure on domestic air
travel, holding of meetings in star hotels and insisting on stay at IQ instead of star hotels. (However
no copy was supplied to the representative union). In the same way we have brought to your notice
the expenditure which can reduced through revamping of vehicle policy, shifting of BSNL offices
from rented buildings, foreign tours, huge building maintenance expenses, electricity & water
charges, huge maintenance charges temporary advances etc. We are not aware whether any
instructions have been issued in this matter.
In this connection, we would like to mention the following areas also where austerity measures can
be introduced.
1. Salary being paid to BSNL officials on deputation to CCA
It is understand that the salary of BSNL officials on deputation to CCA offices are being paid
by BSNL. Since these officials are working for CCA (DoT) the salary should be paid by DoT as
in the case of salary of ITS officers who are on deputation to BSNL is paid by BSNL. The
amount already paid by BSNL has got to be refunded.
2. Claiming of USO Fund in time from CCAs
There seems to be delay in getting the funds from USO Fund. If timely and accurate claims
are submitted there is the possibility of getting this fund quickly. The Circles / SSA should take
necessary action in this regard.
Kindly intimate the action take in these cases so far.

[30.10.2009]Pay Anomaly Committee meeting:- The Pay Anomaly Committee meeting was held on 30-10-2009. Com V.A.N.Namboodiri GS and Com P.Asokababu AGS BSNLEU participated from the Staff side.

The necessity to form another Committee arose since the DoT rejected the agreement of the earlier Anomaly Committee. It stated that Revised Pay Rules and option for pay fixation from the date of next increment falling after 1-10-2000 for those promoted before 1-10-2000 are not applicable for settling the anomaly cases. As such the management stated that it is almost impossible to settle the issues. Management also pointed out that neither in MTNL nor for executives in BSNL it self such anomalies/aberrations could be settled.

The staff side pointed out that at the time of conversion of CDA pay scales to IDA pay scales itself it was assured by the management that these anomalies/aberrations will be sympathetically considered and settled. In the wage revision order (CDA to IDA) also it was mentioned. As such the management has to take suitable decision for early settlement.

After much discussion the official side was prepared to consider the issue of granting personal pay to the extent of the difference to the seniors after promotion of the junior to the higher grade. It will also be considered whether the senior in the higher grade can be given personal pay to the extent of difference between senior in the higher grade and junior in the lower grade.

The next meeting will be held after two weeks.

B.R. Jakhatia, V. Subburaman, P. Asokababu and Babu Singh to prepare a document in full justification of our claim to be put before management.

The meeting also decided to demand the management to hold the meeting of Wage Negotiation Committee urgently and settle wage revision.

Jaipur, Oct 30 (IANS) Petroleum Minister Murli Deora said there is no option but to let all the fuel burn at the Indian Oil Corp depot here where containers and tankers went up in flames Thursday evening and claimed over 10 lives and injuring over 150.

'This is unprecedented in India,' said Deora, who arrived early morning to take stock of the situation, even as experts were brought in both from the Mathura refinery of Indian Oil and the Bombay High oil wells, off the Mumbai shore.

'We will have to let all the fuel burn. Only then will experts be able to go anywhere near the site,' Deora told reporters here after a visit to the site with senior officials of the state-run company. 'We expect the fuel to burn out by evening.'

He said he will also order an inquiry into the matter but after due consultations with Rajasthan Chief Minister Ashok Gehlot. The extent of damage was also being ascertained, he added.

The oil minister said the cause of fire was being ascertained but some eyewitnesses said the fire broke out after gas leaked from one of the tanks, which also caused a loud explosion. The flames could be seen from a distance of over 15 km.

The company has 11 huge tanks and all of them were seen burning. Around 25 fire tenders were pressed into service.

'The incident occurred at around 7.15 p.m. and we immediately pressed ambulances and fire tenders into service,' a district administration official told IANS, adding. 'As a precautionary measure we have evacuated the nearby villages.'

The injured have been admitted to the government-run SMS Hospital and the nearby Mahatma Gandhi Hospital, he said.

'I work in a factory very near the area. As soon as the fire broke out, we rushed out of our factory. We also heard a couple of loud explosions,' Ramkumar, a worker in a small factory, said.

Amit Agarwal, a student of a private engineering college around 2 km away from the site, said the glass panes of his building were shattered due to the explosions.

[13.10.2009]Brief of the wage negotiation meeting on 13th October 2009.

After detailed discussion in the wage negotiation meeting today ,13th October 2009, the management proposed the following:

1. 30% fitment with 10 year periodicity with 68.8% IDA for the present and raising to 78.2% with executives

2. If period of wage revision is reduced to executives, it will be done for non-executives also.

3. There can be a review after 5 years.

The Unions demanded review after 5 years without mentioning the periodicity.

The next meeting will take place after Diwali.

NEW DELHI: With the CBI raids in the offices of the Telecommunication Ministry creating a tricky situation for minister A Raja, the Congress on Monday took the moral high-ground saying that it has ‘zero tolerance’ towards corruption.


This, of course, is the official line. Off record, senior Congress leaders said that they expected Tamil Nadu Chief Minister M Karunanidhi would not insist on ‘defending the indefensible’. Karunanidhi was an astute politician who would not expose his party or the UPA government to opposition mudslinging or allow a media witch-hunt to unroll, they said. The Congress is, in fact, waiting for Karunanidhi to take a call on the issue. A top DMK functionary is expected to meet Sonia Gandhi’s political secretary Ahmed Patel with a message from the CM.

For the moment, the Congress is sticking to a standard line for public consumption. “In the Congress, we are for transparency in public life. We espouse a policy of zero tolerance towards corruption,” party spokesperson Shakeel Ahmed said. Anticipating a united BJP-Left Opposition backlash in the Winter Session of Parliament on 2G spectrum allocation, the party tried to wash its hands off the issue. Ahmed insisted that ‘the relevant facts can only emerge from the government and not from the party’.

The party continued to maintain that taking action against Raja did not arise as his name did not figure anywhere and the raids were against some officials.

Will people recommeding investigation from 2001 will sell their property (land or gold ) in 2007 at the same price of 2001. So it is a question of VALUATION, VALUATION. Second license given to people who have no previous experience in Telecom and that too so many circles at such low VALUATION. Imeediately after getting license these companies enter into negociations to sell the stake and make HUGE windfall profit. That is what stinks. Raja may not have control of this but he is the catalyst in this. Investigation need not be from 2001 as some people are saying in this blog and the same posts in DINAMANI blog. This will only delay the investigation and make RAJA escape.

In Feb 07, it changed its name to Swan Telecom Pvt ltd.. Swan Telecom P Ltd, was allotted by fraud the 2G Spectrum license by Raja. Swan agreed to invest 49% in Raja’s Green House Promoters Pvt Ltd at a dictated price of Rs 1,000 crore. Swan Telecom bagged the licence for Rs 1,537 crore for operating in 13 circles. Within weeks, it sold 45 per cent of its shares to Etisalat, of UAE for $900 million (Rs 4,500 crore). In Oct 2007, the corporate house, that was already a strong name in the CDMA sector, quit the firm after the Centre announced a new telecom policy that allowed one company to operate both GSM and CDMA services. Soma Networks is a US-based company floated by Indians. Former Planning Commission member MS Pathak, son of former Vice-President of India GS Pathak, is the chairman of Soma Networks. Yatish Pathak, MS Pathak’s son, is the Chief Executive Officer of the firm. WiMax is a high-speed Internet service that provides connectivity in mobiles and laptops. The BSNL decided to invite franchisees from private players for providing WiMax services. Raja’s method is to give BSNL 25 per cent of revenue while 75 per cent will go to the private player. The annual revenue from WiMax is expected to be Rs 900 crore, according to BSNL estimates. A total of 11 companies responded to BSNL’s WiMax franchisee allotment.

Neena Vyas Share · print · T+ The Central Bureau of Investigation’s first information report on the telecom licence and spectrum scandal has charged “unknown officials” of the Department of Telecommunications with carrying out a “criminal conspiracy” to award licences “for a heavy consideration” by “putting a “cap on the number of applicants against the recommendations of the TRAI” (Telecom Regulatory Authority of India).

Filed on October 21, the FIR, a copy of which was made available to the press by political sources, also charged these officials as having awarded licences on a first-come, first-served basis on 2001 rates without any competitive bidding.

A specific charge is that the government suffered an estimated loss of Rs.22,000 crore. A case has been made of favouritism. On September 24, 2007, through a press release, the DoT stated no new applications for licences would be accepted after October 1, 2007. Between September 25, and October 1, 2007, a large number of applications were received, but none accepted.

On January 10, 2008, letters of intent were issued to nine service providers for 122 telecom circles on the basis of applications received by September 25, 2007, thus showing them “favour.”

This was later justified by the Department saying that the applications received first would be processed first, and if found eligible, be given licences.

Then again, according to the FIR, an “arbitrary condition” was imposed saying that licences will be issued first to those depositing the fees first. It noted that favour was shown to some applicants to whom this information was leaked in advance so that they could get the money together and deposit it before others.

Without any valid reason, applications received after September 25, 2007, were rejected and licences given to a “few selected companies at nominal rate” causing “wrongful loss to the government of India and a corresponding gain to private persons estimated to be more than Rs.22,000 crore,” the FIR stated.

Open and shut case, says Jaitley
Bharatiya Janata Party leader Arun Jaitley described the scandal as an “open and shut criminal case.” He charged the CBI with attempting to “dilute the scale of the scandal” from roughly Rs. 60,000 crore to Rs.22,000 crore.

He said it was simple arithmetic. Taking up the illustration mentioned by the CBI in the FIR: A company named Swan was allotted licences for 13 circles for Rs.1,537 crore. It offloaded 45 per cent of equity in this shell company to a United Arab Emirates based company Etisalat for Rs.4,200 crore. The CBI calculated the loss to the government by deducting Rs.1,537 crore from Rs.4,200 crore — Rs.2,663 crore, and has done a similar exercise for all nine licences.

However, Mr. Jaitley pointed out that since 45 per cent of the equity stake was sold for Rs.4,200 crore, it was a matter of simple arithmetic that 100 per cent equity was worth more than Rs.8,800 crore and the loss was to the tune of more than Rs.7,200 crore in this case alone.

“If you look at each of the figures for the nine licences, the total figure comes to more than Rs.60,000 crore with each licensee having made a clean profit of around Rs.7,000 crore,” Mr. Jaitley emphasised.

Where is this competition leading us? According to analysts, such intensive competition will have negative impact on profit margins. Stock markets too have reacted negatively to these developments. There is a lot of buzz in the market around the impending round of consolidation. There have been predictions that this competition will lead to increased M&A activity in the markets especially among the small, regional and new operators.

It is doubtful that there would be a large scale domestic consolidation in the Indian mobile space in near future (though there might be some activity where large operators gobble up smaller and regional players). There are many reasons for it. First, according to Trai guidelines, new operators cannot participate in M&A activity before completing three years of operations. Second, large operators are looking outside domestic markets where there is scope for replication of their ‘Indian model’ of cost reduction – outsourcing and infrastructure sharing. Third, the tariff competition though predatory will lead to larger subscriber base overall. Fourth, M&A is risky – majority of research about the impact of M&A on firm performance shows that M&A may not realise desired results. Fifth, there are other opportunities to increase profit margins – data and enterprise applications.

In saturated telecom markets such as the US and Europe, data forms a larger proportion of ARPU (Average Revenue per User) compared to voice and there are no reasons for India to be any different. In fact, the mobile industry has already seen a 153 per cent year-on-year increase in the number of subscribers using mobile to surf the internet in 2009. At present, telecom operators in India are concentrating on increasing voice subscribers; it is only a matter of time before operators shift focus to increasing their share of revenues from data traffic. In next couple of years, there is a higher possibility of increasing rationalisation of data tariffs to stimulate usage of internet on mobile phones and other value added services.

There is a general criticism of future viability of value added services in India due to the absence of ‘killer app’ and delay in the roll out of 3G licence. No doubt 3G technology would increase the scope of value added services that can be provided to subscribers, but telecom operators can increase their share of revenues from data through mobile internet till the time 3G services are rolled out. And as far as developing that killer app is concerned, customer segmentation, that is, services targeted towards a niche market, will be the key to the success of value added services.

Value added services targeted at the rural subscribers would be another important focus area in next 3–5 years. The challenges for mobile operators in rural areas would be similar to those in urban areas –- falling revenues from voice traffic and strained profit margins. Given the low income levels, high sensitivity to price and low rate of literacy, rural India would spend on services that would improve their prospects of increasing income in the future.

Telecom operators have started offering value added services for enterprises like mobile application tools, vehicle tracking solutions, meter reading solutions etc. This segment is still in a nascent stage as enterprises are concerned about the security aspects of these services. The take-up rate is slow at present but it presents huge possibilities for the telecom sector.

For now it is too early to expect consolidation in this industry as mobile operators will first exhaust other opportunities. Rather it is possible that value added service providers in India might see M&A activity in the near future rather than the telecom sector.

London: President Pratibha Patil today met British Prime Minister Gordon Brown at his official residence 10, Downing Street for a half-hour exchange of views.

Patil was accompanied by Minister of State for Human Resource Development Daggubati Purandeswari, Foreign Secretary Nirupama Rao and other senior Indian officials, including Joint Secretary (Europe) Rajesh Prasad.

The meeting between Patil and Brown is the first such since India and Britain signed a landmark strategic partnership agreement in 2004.

Brown also met Patil on Tuesday at a state banquet thrown in her honour by the British queen in Windsor. (IANS)

Shri Kuldeep Goyal Chairman & Managing Director, Bharat Sanchar Nigam Limited (BSNL) launched prepaid Broadband services of BSNL on 23 rd of Otcober, 2009. The services are currently available for the subscribers in Karnataka Circle. The service will be extended to other circles progressively by the end of the year.

Overview

Initially the customers will be given an account with username / pass word with 50 MB free download and validity of 15 days. Before the expiry of validity or download limit, the customer will have to purchase Re-charge Vouchers (RCV) available in different denominations and recharge his/her account. A customer can opt for either of the following two types of prepaid account:

• Unlimited Download: There are four types of vouchers of different denominations which offer unlimited down at speeds ranging from 256 Kbps to 2 Mbps which can be used for unlimited down load within the validity period of the voucher.

• Limited Download: There are 9 types of vouchers of different denominations which offers limited download at speed upto 2 Mbps within the validity period of the voucher.

In addition, there are two other types of Recharge Vouchers for limited plans. One, for extending the validity period (Validity Voucher) and the second, for increasing the usage (Top up Voucher) within the validity period.

Spectrum: Congress defends Raja; 'largest scam in India': BJP

New Delhi: The Congress Monday strongly defended Communications Minister A. Raja, saying his name did not figure in the case related to the controversy over awarding 2G spectrum licences last year. In the meantime, the BJP said it was the "largest scam in independent India" that cost the government a whopping "Rs.60,000 crore".

"The minister's name has not figured in the FIR (first information report). Only some officials' names have been figured," said Congress party spokesman Shakeel Ahmed here.

The Central Bureau of Investigation (CBI) last week searched the offices of the telecom ministry to probe the alleged "criminal conspiracy" between some officials and private companies in giving wireless radio spectrum to telecommunication firms.

"The minister's office was not raided. Only some offices under his ministry were raided," Ahmed told reporters.

Criticising the Bharatiya Janata Party (BJP) and the Communist Party of India-Marxist (CPI-M) for demanding Raja's resignation, the Congress said the two parties did not have the right to speak against corruption as their top leaders' role in some scandals were probed by the CBI.

The Congress referred to former BJP president Bangaru Laxman's bribery case, which was exposed through a sting operation and CPI-M Kerala leader Pinarayi Vijayan's alleged involvement in the multi-million SNC Lavalin scam.

Ahmed said the Congress is a party that stands for "transparency in public life and zero tolerance against corruption".

Spectrum allocation is 'largest scam in India': BJP

The opposition Bharatiya Janata Party (BJP) Monday said the alleged irregularities in allotting wireless radio spectrum and licences by the telecom ministry to nine private operators in 2007 was the "largest scam in independent India" that cost the government a whopping "Rs.60,000 crore".

"In terms of monetary value, it is the largest scam in independent India. It is a monumental scam. It cannot be a subject of controversy. It is a mathematical calculation," Leader of Opposition in the Rajya Sabha Arun Jaitley told reporters here.

Demanding that Telecom Minister A. Raja of the DMK should be sacked, the BJP general secretary took exception to Prime Minister Manmohan Singh "intervening in the matter".

"I don't think the prime minister should intervene when the investigation is on," Jaitley said.

Manmohan Singh said Sunday that allegations about the scam were incorrect but he refused to answer a question about the opposition parties' demand that Raja should resign following last week's Central Bureau of Investigation (CBI) raids on the offices of his ministry.

Rules of the game were changed

Jaitley said the government had in 2007 recommended an "open licence regime".

"Applications for telecom licences were invited setting Oct 1, 2007, as the deadline. An artificial cut-off date, Sep 25, 2007, was created and applications received between Sep 25 and Oct 1 were summarily rejected. Rules of the game were changed after the game had begun," he said.

The BJP leader alleged that "all friendly applicants, mostly real estate companies, had been advised to put in their applications before Sep 25".

The licences and the spectrum allocation were then alloted to nine operators at a price of Rs.1,650 crore per operator, he said.

"This price," he said, "was not taken on the basis of the 2007 market value but on the basis of an auction held in 2001.

"The value of the licence and spectrum in 2007 could not be the same as in 2001. The telecom market has grown phenomenally during this period," he said, adding the companies "post allotment didn't operate the service".

"All they (the private companies) owned was a shell company and a guaranteed spectrum. They availed 74 percent Foreign Direct Investment (FDI) policy of the government and found buyers and joint venture partners from the international market," Jaitley said.

"The companies were overnight valued at over $2 billion (over Rs.9,000 crore) and a large chunk of the equity was sold by at least three licencees to overseas partners at a price of Rs.6,000-7,000 crore. Obviously the government lost over Rs.60,000 crore for the nine licences collectively along with the spectrum," he said.

Alleging that the United Progressive Alliance (UPA) was trying to "cover up" the scam, the BJP leader said, "It was unfortunate that the prime minister has chosen to comment on the innocence of the minister".

"The compulsions of the coalition politics should not come in the way of the an honest investigation. The minister should cease to be in office. His continuation is itself a deterrent to an honest investigation," the BJP leader said.

"It is an open and shut case, not only for the investigation and trial but for conviction also," he said.

Under this plan Local call to any network will be charged at one paise per second and STD call at two paise per second . MRP of this STV is Rs.45/-. MRP of India Golden 50 Special Tariff Voucher has also been revised to just Rs. 99/- and a new STV India Golden 50 Plus with MRP Rs.49/- has been introduced. Various other cost effective and attractive STV options are available to suit your requirements. You can make local calls to own network for as low as 10 paise per minute and STD call at 50 paise during night from 11 PM to 7 AM. Two new tariff plans have been introduced for 2G prepaid mobile customers (excluding Anant customers ) under category Balance Based Tariff (BBT) and Usages Based Bonus (UBB). GPRS Pack of unlimited free usages in home LSA is available for Rs.230/- only. Promotional tariff is available for unlimited data download for 2G data card for 90 days from 16.09.2009 under which fixed monthly charge for post paid category has been reduced from Rs. 900/- to Rs. 649/-. For pre-paid customers, price of re-charge vouchers has been reduced from Rs. 850/30 days to Rs. 649/30 days.

High speed Broadband upto 24 mbps is now available for both Home and Business categories. New Broadband Combo Plans for Limited /Unlimited usages have been introduced last month. We never forget consumers in rural areas. In association with other Departments of the Government of India, we are making efforts to make information accessible to them. National Broadband Penetration Programme has been developed to bridge the rural-urban digital divide. The programme aims to break-through affordability barriers. We have partnered with M/s HCL Infosystems Limited to make available PCs at a nominal payment of Rs.2250/- and Rs.300/- per month towards the cost of the PC. Broadband connectivity will be extended by us at subsidized rate of Rs. 99/- and Rs. 150/- per month. We believe in inclusive growth of the economy which can be accelerated by reaching to rural masses. Backbone infrastructure is being created by us to provide broadband connectivity to Village Panchayats, Post Offices, Schools and Universities and Common Service Centres being set up by Department of Information Technology in the rural areas.
