GS spoke to Sh Deepak Parekh, member of the high power committee constituted by Hon’ble PM, under the Chairmanship of Sam pitroda, presently in Mumbai, and requested him to grant this Association an opportunity to present its views on the crucial matter of drafting and finalizing future road map for BSNL to bring it out of the horrible mess that it is in now – a challenging task assigned to the committee. Sh. Parekh felt that it would be appropriate for the committee to meet us only after the return of Sh. Sam Pitroda from US. However, we were advised by him to mail our views which we have already done. The same views have been already mailed to Sh Sam Pitroda. Sh. Parekh also informed us that the committee is expected to submit its report to Hon’ble PM towards the end of Feb.10. We are also in touch with the office of Sh. Sam Pitroda and are following up our efforts to fix up time for a telephonic conversation with Sh. Sam Pitroda to explain our views.

26th Jan 2010We all should hang our heads in shame – Market drubbing, rampant corruption and scandals galore in BSNL. WiMAX scandal- reportedly involving Director(CM), a strong contender for top slot in the BSNL board.

Hats off to Sh. P.R.Ananthan, CGM(STP), and Sh. Sat Paul, CVO, for their outstanding integrity and timely stern stand and action to stall yet another big scandal in BSNL.

Whether or not 1500 odd top managers of BSNL hang their heads in shame for BSNL being continuously kicked by private operators like a football , we in our Association have no reason not to hang down our heads for the continuing disgrace into which our beloved Company is brought into not by rapidly declining market position and continuous drubbing that it gets in telecom market but also by revelation of one scandal after one, the latest one being almost issuing of APO for procurement of WiMAX Rural tender Project II to a Hyderabad based Company VMCL facing not only serious charges of customs tax evasion worth Rs 55 crores but also criminal charge of having violated the integrity panel by falsely declaring that there was no criminal charge against it.

While in the market standing, BSNL, pushed very recently to fifth position by till recently a tiny operator, IDEA, has been now kicked down to the sixth position by Tata Teleservices in the GSM segment with induction of record 3.3 million mobile lines on GSM platform (DOCOMO) for third consecutive month in Dec.,09, on the mounting corruption and scandal front, Director(CM)/BSNL board, a strong contender for top slot of BSNL board, just brushed under the carpet the timely and serious recommendation of CGM(STP), Sh P.R.Ananthan, Chairman of the tender evaluation committee, to refer the award of contract for procurement of WiMAX equipment to VMCL to Chief vigilance officer, BSNL, to probe the violation of integrity pact by VMCL by falsely claiming that there was no criminal charge pending against it. Not only did Director(CM) blatantly ignore the crucial advice of Sh P.R. Ananthan, an officer of outstanding and impeccable integrity, to refer the issue to CVO/BSNL for investigating a criminal offence of VMCL but he accorded his approval to issue APO to VMCL for supply of WiMAX equipment as L4 vendor.

It was only timely and bold intervention of Sh Sat Paul, CVO/BSNL, acting on an independent representation, because the complaint was never forwarded to him by Corporate office of BSNL, as recommended by CGM(STP) , that the award of APO to VMCL, an alleged customs tax evader, has been put on hold.

This is how Directors of BSNL board conduct the affairs of a Company which is already profusely bleeding. We are confident that similar serious irregularities are detected by CVC in the matter of procurement of 93 million GSM equipments on the pricing front, prompting their timely intervention to put the whole thing on hold which has started jeopardizing future growth of BSNL. Big and serious questions need to be answered by Director(CM) on the price front of the GSM tender also. All these facts we shall adequately reflect when PESB starts deciding on who the next incumbent for the post of CMD/BSNL shall be. Interestingly and significantly, growth of Bihar Circle nosedived like anything when the present Director(CM) was the Chief executive of BSNL in Bihar Circle.

In the meanwhile, we have just no words to commend and salute the great and timely efforts of Sh. P.R.Ananthan, CGM(STP), and Sh Sat paul, CVO/BSNL, to stall what would have been yet another big scandal in BSNL.

In fact, Corruption in BSNL has started assuming alarming and wide spread proportions at the SSA/Circle levels. Strong vendor-SSA/Circle head nexus is fast growing in many vulnerable Circles, particularly in the Northern Zone. A vicious circle of good number of CGMs/GMs in the Northern region has started eating into the vitals of the Company very fast. Active involvement of SDEs/DEs and DGMs in this nexus is not at all ruled out. In fact, active complicity of SDEs/DEs/DGMs in this nexus is more or less reported and established.

We warn SDEs/DEs and DGMs of grave consequences of such filthy acts of complicity which are endangering our bread and butter. We cannot be silent spectators towards all these threatening developments. Thus, we call upon our office bearers and activists at all the levels of the Organization to come out fearlessly, courageously and openly in exposing the growing vendor nexus and other corrupt practices. Don’t be scared of exposing CGMs/GMs and our own brethren involved in such unscrupulous activities. Be bold, have strong determination, be fearless in ruthlessly exposing corrupt colleagues and officers alike. Don’t shirk from this important responsibility at this crucial juncture since corruption is fast depleting the scarce resources and hitting at our bread and butter.

Rise to the occasion and face and expose unscrupulous and corrupt elements at all levels boldly and fearlessly. The choice is between exposing corrupt elements which are fast growing in number and protecting our bread and butter and our beloved Company from crumbling for all times.

Association very strongly takes up the issue of induction of highly talented, professional and capable of deliverance people as CMD and Directors, bsnl/board with Hon’ble PM in his capacity of overseeing the functioning of department of personnel and administrative reforms. PESB, which decides the selection, is under DOP&AR. GS urges upon Hon’ble PM to give a dispassionate and serious consideration to induct extraordinary talent, considering the hard fact that exclusively ITS controlled non professional Management has miserably failed to deliver on all fronts for the last ten years, at the top, capable of steering the Company in grave crisis and in a fiercely competitive environment. Association also conveys its comprehensive views on the matter to Sh. Sam Pitroda and Sh Deepak Parekh, members of the high power committee constituted by Hon’ble PM to draw future road map for BSNL against the backdrop of 93 million GSM tender being put on hold by CVC. Chairman, PESB, and all its members, including Secy/PESB, have been elaborately apprised of the need of roping in rarest of rare talent to lead the Company from the front. Hon’ble Minister of State for Personnel and Administrative reforms, Sh Prithvitaj Chavan, Secy/DOT, Secy’s DOP&AR and Secy/DPE have also been extensively enlightened about the issue in entirety. Non-existent firm set to be BSNL’s WiMax franchisee


Yet another mega scam has been added to the continuing saga of fraud and corruption in the functioning of the Telecom Ministry under A Raja. One of the companies, shortlisted for BSNL WiMax franchisee across India, does not exist.

Of the four shortlisted companies, a firm called Ampules, designated to operate in Chennai, Haryana, West Bengal and Himachal Pradesh, is not at all registered in India. The Ministry of Corporate Affairs online registry shows that no such company is registered in the country till this date.

This gross irregularity has happened despite specific BSNL guidelines which make it mandatory that a WiMax franchisee company should be registered in India and must have Rs 100 crore turnover per year in the last two years.

Only one company having a similar name — Ampoules — is registered in India, but it has nothing to do with telecom as it is a pharmaceutical company. The full name of this company is Ampoules and Vials Manufacturing Company Limited and it was established in Mumbai in 1972.

“If any discrepancy found, we would take action. These companies have only been shortlisted. Actually, all these procedures were initiated by Chennai unit of the BSNL. Let me verify the documents of Ampules. I am not sure about their details. If any violation is found, we would take strong action,” BSNL Chairman and Managing Director Kuldeep Goyal told The Pioneer on Tuesday.

The Pioneer has learnt from reliable sources that the so-called Ampules (or Ampoules) is in the process of being floated by some Tamil-origin Malaysian citizens, believed to be connected with the Wellcom Communications, promoted by friends of A Raja. Their application is pending before the Chennai RoC.

Sources said the Telecom Ministry exerted pressure on BSNL officials to include this firm, but the question remains how this unborn firm will pass the BSNL’s criteria of Rs 100-crore turnover per year for last two years.
After the controversial allocation of 2G spectrum, Raja was trying to involve his friendly companies in the lucrative WiMax franchisee allotment. First, he tried to allot the franchise to Wellcom Communications, the company floated by his Malaysian friends and one T Silvarajoo, a frequenter in his office and hailing from his home town Peramballur.

When this move was reported by The Pioneer, Raja took a different route last year by engaging one of his close aides Sanjay Kapoor to float five shell companies, registered on a single date, same notary, auditor and witness. The posts of directors of all these five companies were filled by Sanjay Kapoor’s family members, including his driver. After The Pioneer expose, the PMO asked the BSNL to cancel the process. Then, the BSNL floated new Expression of Interest (EoI) with specific conditions in June 2009.

Last week, the BSNL finalised four firms, including the non-existent Ampules (or Ampoules) for allotment of WiMax franchisee. The other three firms are Teracom Limited, Adhishwar India Ltd and Chennai-based Take Solutions Ltd.

Teracom, already in the telecom sector, and supported by the multinational Cisco bagged the maximum number of circles. Adhishwar and Take Solutions are considered as new entrants in telecom sector and are supported by Israel-based Alvarion and Chinese ZTE respectively. The non-registered firm Ampules (or Ampoules) is also supported by Israeli Alvarion. The application of E-mall Infotech was rejected.

WiMax (Worldwide Interoperability for Microwave Access) is faster than 3G and 4G in providing internet connection to mobiles and laptops. The BSNL’s WiMax franchisee is considered as a lucrative business, as the private players get 70-80 per cent share of the revenue, out of the expense of the public sector undertakings’ huge infrastructure. The franchisee also enjoys the advantage of holding of 20 Mega Hertz of Spectrum, which they could off load stakes at an exorbitant price to another company. In case of 2G spectrum allotment, real estate companies Swan and Unitech sold their stakes to multinationals at huge margin.

The BSNL’s Rs 1,000 crore plan to roll out WiMax in rural areas is also dogged in controversy. The Hyderabad-based Vippalamritha Magnetic Components Ltd (VMC), which had emerged the fourth lowest bidder for the project, has been put under scanner for alleged evasion of duties by its parent company while importing equipment for an earlier BSNL contract.

The Directorate of Revenue Intelligence has also issued a show-cause notice to Prithvi Information Solution, the parent company of VMC, for the alleged non-payment of Rs 55 crore as duties. The other selected vendors of BSNL are Chennai-based Gemini Communications — a new entrant, Chinese ZTE and US-based Harris Stratex.

The BSNL allotted the most revenue earning circles — Maharashtra, Gujarat and Andhra Pradesh — one year ago without any tender to US-based Soma Networks. Former Planning Commission member MS Pathak, son of former Vice-President of India GS Pathak, is the chairman of Soma Networks. Yatish Pathak, MS Pathak’s son, is the Chief Executive Officer of the firm.

BSNL rolls out video phone commercially.Hoping that the newly launched video telephony, by BSNL and Sai Info Systems (SIS), will boost demand for broadband connection, Sam Pitroda, advisor to Prime Minister on public information, infrastructure and innovations, expects the number to hit 100 million in next five years.
Unveiling the Video Phone services in Gujarat for commercial use, Pitroda said, "It took 50 years for video telephony to move out of laboratories into market. However this new step in telecom holds the key behind a big jump in broadband connections in India. At present, the number of broadband connection is less than 10 million, but services like video telephony is bound to generate fresh demand for the broadband service. We hope to have 100 million broadband connections in India next 3-5 years."
Being offered by state-owned telecom operator BSNL in association with Ahmedabad-based IT solution provider SIS, the video telephony services will require land line telephone as well as broadband connections. With the help of a separate device, the service will allow subscribers to make video calls at Rs 2 per minute.
"We will begin offering video telephony services in association with SIS from January 22, 2010 while the connections will be offered from February 1, 2010 onwards. Initially, the service will be available to BSNL customers in Gujarat and by April, 2010, customers across the country will be able to avail the service. While the audio call will cost subscribers Rs 0.40 per minute, video calls can be made at Rs 2 per minute," said SK Bhandari, principal general manager, BSNL.
The video phone service will be available in wire line as well as wireless medium on IP. According to Vijay Mandora, director of SIS, a wide range of phone equipment from simple to high end models will be introduced in the market.
"The service is expected to revolutionize the telecom sector and take it to the next level. Globally with video phones have become an integral part of life. The service will be provided and marketed by SIS while the connectivity for the service will be provided by BSNL. BSNL will also market it as another value added service to its large broadband customer base," said Mandora, director, SIS.

The Centre hopes to garner Rs 25,000 crore from the auction of 3G spectrum for mobile telephony, which is expected to be completed by next month, according to Mr A. Raja, Union Minister for Communications and Information Technology.
He said the 4G spectrum, the launch of which is still some distance away, would not cannibalise 3G spectrum and both technologies could co-exist.
Telephone tariff to come down:The Union Minister of Communication and IT A. Raja has said the tariff for telephone call within a State will come down to 10 paisa a minute and within the Country to 20 paisa soon.
Launching the 3G services of BSNL in Coimbatore and Nilgiris in Tamil Nadu today, he pointed out that while the prices of all other things are going up, it is only the cell phone tariff which is coming down. He said telephone connections in the Country crossed 500 million by December last year which was the target for the year 2012. Last month itself 18 million cell phone connections were given in the Country.
The Minister said the number portability would become a reality by March. Asked when the BSNL would go public, he said “it is for the Cabinet to decide.”
Speaking to presspersons in Coimbatore on Saturday, he said the roll out of 3G spectrum across the country is expectedto be completed ‘within this year'. He said the auction for 3G spectrum is expected to be completed by next month after which competition would intensify with the entry of private telecom players into this field in which the PSU telecom players BSNL and MTNL had got a head start.
Asked about the expected revenue from the bidding war among private telecom players seeking 3G spectrum allocation, he said: “We do expect that at least Rs 25,000 crore must come” including Wi-max and 3G. While there will be one-time payment at the time of auction itself, there will also be revenue from it subsequently.
When asked about market speculation that some prospective bidders may stay away from 3G because of the belief that the launch of next generation technology 4G spectrum is not too far away, Mr Raja said even in the International Telecom Union, definitive conclusions about 4G technology were yet to be reached after which it has to undergo trials. “We are foreseeing a technical revolution in 4G' and it might take another year for 4G to be introduced, he added.
Commercial viability
The Union Minister did not agree with the view that the possible launch of 4G may hold back some of the telecom players from entering the bidding process for 3G spectrum allocation and said there was ‘commercial viability for 3G'. Even if 4G comes, it would not affect 3G.
On the price war among telecom operators, he said till he assumed leadership of the Communications Ministry, the stand was that market forces would decide the tariff. But there was no healthy competition earlier and the tariff remained stiff. But healthy competition inthe sector, the tariff has started a downward journey and now operators were asking for fixing minimum tariff.
Asked about the reasons for the declining market share of BSNL in the mobile telephone sector, Mr Raja said landline was a huge burden for the company and it has to take care of 2.5 lakh employees. It also took nearly 18 months to close a tender as it had to follow Government laid procedures. He had consulted the Prime Minister on simplifying procurement norms and this was one of the reasons for the PSU behemoth losing ground in mobile telephony to private operators.

Sub: Inevitable and imminent need to induct high grade qualitative professional talent at the top level in BSNL – existing bureaucratic and outdated selection mechanism of PESB requiring drastic transformation and revamping.
Respected Mr Prime Minister,
It is with great elation and excitement that we learnt about your appointment of a Committee chaired by Sri. Sam Pitroda to look into the maladies that afflict the working of BSNL and revitalize this crucial Public Sector Undertaking before it slumps beyond a point of no return. While we welcome this timely step at the highest level of the Government igniting hopes that the battle to save this great PSU will continue in earnest, we would like to bring to your kind attention a few vital points that require your careful examination and prompt action.
It is but a fact that BSNL being a PSU has to undergo all the hassles that normally plague such PSUs and delays the decision making process, which is of vital importance to the PSU facing the worst kind of competition with so many competitors, unfettered and unshackled, strangulating it with political patronage. Naturally such long processes and political interferences are not conducive to the fast changing market dynamics and the lightning paced technology changes. The result is that the PSU is never able to meet the demands of the market always handicapped by the scarcity of vital equipments and materials at the ripe time. Your good self, we are sure, is not unaware that this can be achieved only if the PSU is empowered with financial freedom to take prompt decisions to go in for state-of-the art technology of sufficient capacity, so that the great demands of the market can be effectively and promptly met.
The 2007-tender fiasco, presided over and meticulously crafted by the present MOC&IT, which literally ensured that the wings of this strategic PSU, which till then was vying for the top spot in the market along with Airtel, despite being a very late entrant in the GSM segment, were clipped off and it was totally thrown off its feet. Its deliberately delayed entrance into strategic and highly potential mobile market in 2002 was again a politically motivated decision to lend huge strategic business edge to other private operators in terms of allowing them to capture huge strategic market at peak time. The result is that today the once contender for the number one spot in just 2006 lies at an awfully low sixth, with a mere 12% market share. Unwarranted and fatal Governmental interference in 2007 by heavily sizing down procurement of GSM equipment without ant plausible reason cost it very heavily, and when the market grew at an unprecedented alarming pace from 2006 till date, the PSU could not even creep or crawl for want of sufficient capacity. Until just 3 or 4 months ago the Company bled while the competitors were allowed to drink of this blood and grow fat at its expense and the objective of vested interests and manipulators was achieved. Harrowing and disastrous result is there for everyone to see.
While the Government can never be pardoned for fatal, politically motivated and unwarranted interference in year 2007 , which can never be compensated by any other corrective action for obvious reasons, we cannot ignore the fact that the top Management of the Company also has to be squarely blamed for its lackadaisical subservience to the lords. While it was their bounden duty to act in the interests of the Company, which they had to command and steer, they simply fell flat on their feet to prostrate before the lords in the government being more loyal to the king than the kingdom and the people. That is where we feel that this Company cannot survive under such servile Management, which, we are sure, cannot rise above the interests of the lords. Their totally unprofessional, uncommitted, devoid of vision, innovativeness and pragmatism, conservative, non competitive and unplanned approach, clubbed with complete lack of astute governance skills and robust leadership ingredients, has landed this prestigious Company into the worst dump from which it is almost impossible to rise up again.
During their command the last 10 years have witnessed the worst slump not only in market share but also in the revenue and profit fronts. It is so scary that even though the Company could keep itself above the red margin so far, thanks to the interest from the reserves, the ongoing year portends to be the first loss making year. It does not take great minds to conclude that the slump has been created not only by Governmental procedures and interference but by the lack-luster performance of those entrusted with the challenging and crucial job of driving this gigantic PSU into excellence. Incredible manner in which Companies like France Telecom, NTT and China mobile with governmental holdings have remarkably retained their position, some of them having even achieved global rankings, as leading service providers in their Country in a fiercely competitive environment is being largely attributed to high grade professional leadership capable of running complex telecom enterprises. Surely not the kind of leadership that we have been having on the board - born, brought up and groomed in a highly protective and non competitive market, conservative and monopolist environment, where qualitative service delivery, excellent customer interface, accountability and timely deliverance of results were nightmare.
Thus the issue fundamentally boils down to induction of the rarest of rare talent in the board, definitely not through the orthodox and primitive mechanism that PESB has in place at the moment. The criterion cannot be just ITS seniority, based on redundant performance mechanism (CRs) – bereft of objectivity, having no relevance in present complex scenario and assessed by ITS fraternity in a monopolistic and non competitive world. These surely cannot be the parameters to decide top slots to run a gigantic Company virtually in shambles today, plagued by anarchy, rampant and virtually all round corruption, indecisiveness, total lack of accountability, growing indiscipline, worst possible work culture, menacingly growing vendor- manager nexus, and what not. Assertiveness and ruthlessness of the top leadership in holding people accountable for their persistent failures and non deliverance would have had miraculous impact down the level. But alas – parochial fraternal ITS considerations have kept and keep top management from meaning tough business and deliverance of results in a time bound manner. That thinking and vision is altogether amiss. Otherwise, how is it that despite unabated debacles on all the business fronts, not a single head out of 1400 top heads has been rolled down. That would have automatically led to percolation of rolling down of heads, fixing of responsibility and accountability, qualitative service delivery down to the lowest rung in the Organization, and would eventually have had a miraculous impact on performance.
It is in this context precisely that we are constrained to infringe upon your valuable time, as head of DOP&AR overseeing the mechanism and crucial process of selection of Directors/CMDs of strategic PSUs considered to be the nerve centers of Country’s economic activity, to kindly direct the concerned officers to have a pragmatic and urgent look at the existing outdated mechanism of selection, revamping and replacing it by adoption of a thoroughly innovative and professional approach to fill top slots of a Company where government holds 100% equity and whose sole objective is to fulfill the social obligations of the government in terms of achieving its envisaged agenda of providing universal telecom services of highest quality at affordable prices. So what we need is a Management with a thorough professional breeding, approach and vision. This has to look beyond the available domains of ITS cadres into the best Management professionals of the country, the best leaders and talents available in the vast professional spectrum rather than looking through the narrow prism of the ITS fraternity which hitherto has miserably failed to deliver on all fronts. Ten years of continuous governance has adequately demonstrated their complete inability and incapacity to push through the Organization in a climate diametrically opposite to the one in which they have got groomed. They have utterly failed to prove their managerial mettle and business acumen.

NHRC's Winter Internship Programme concludes


New Delhi, January 15th, 2010

NHRC's one month long 10th winter internship programme on human rights concluded in New Delhi today. Addressing a gathering on the occasion, NHRC Acting Chairperson, Mr. Justice G.P. Mathur congratulated the interns and expressed hope that they would act as ambassadors for the protection and promotion of human rights, and take appropriate steps to ensure justice for those whose human rights are violated. At the same time he also reminded them that there are no rights without duties.
Justice Mathur asked the interns that they should disseminate knowledge attained during their internship on human rights related issues among others, and particularly those of their colleagues who could not make it to the short listed candidates for NHRC's internship programme.
55 candidates from different institutions and universities in the 20 states and union territories of the country attended the internship programme which commenced on the 17th December, 2009. This number is highest so far. They included, for the first time, three students from foreign countries, currently studying in Indian Universities. One among them was from Indonesia and two were from Afghanistan.
The best intern award of Rs.5000/-, this time, was shared by the two interns, Caroline Tanjaya and Suvra Kanti Roy, who were given an amount of Rs. 2500/- each. Students coming from Delhi and National Capital Region Delhi were given a stipend of Rs. 2500/- and others Rs. 5000/- each for the internship programme.
The interns mainly comprised post-graduate level students of law, political science, social work, criminology and human rights. The aim of the internship programme was to sensitise the young students about the various aspects of human rights.

Hyderabad-based Vippalamritha Magnetic Components Ltd (VMC) which had recently emerged as the fourth lowest bidder for BSNL’s rural WiMAX network rollout project is under scanner for alleged evasion of duties for an earlier contract granted by BSNL, reports the Business Line.

Following this, BSNL’s internal vigilance officer has put a stay on giving any new order to the firm. The Business Line report also states that the Directorate of Revenue Intelligence (DRI) has also issued a show cause notice to Prithvi Information Solution, the parent company of VMC, for the alleged non-payment of duties.

“Since the investigation in this case is going on, it was requested that no order should be placed at this juncture with VMC,” states an internal BSNL note.( TT Jan21)

IPO Not the Cure for BSNL's Ills

The long-proposed IPO of India's Bharat Sanchar Nigam Ltd. (BSNL) is unlikely to change the fortunes of the beleaguered incumbent operator, according to a former senior executive at the state-owned carrier.

Critics of the move, which could involve the flotation of a 10 percent stake on India's stock exchanges, say BSNL doesn't need the cash: Indeed, government figures for the end of September 2009, put BSNL's cash reserves at 364 billion Indian rupees (US$7.9 billion).

In addition, with telecom stocks not performing well on the Indian exchanges, any near-term IPO is unlikely to attract a favorable valuation for BSNL.

"What is the point of an IPO?" asks Dr. SD Saxena, BSNL's former finance director. "The government will not get the right valuation. The telecom stocks are not doing well. Besides, BSNL is not doing well. The revenues are consistently coming down, and the ongoing tariff war has further put pressure, not just on BSNL, but on all operators. So there is hardly any likelihood of an IPO getting a good response," Dr. Saxena tells Light Reading.

According to The Economic Times, the IPO, which is strongly opposed by the trade unions that represent many of BSNL's 300,000-plus staff, could take place during the carrier's next fiscal year (April 2010 to March 2011).

Dr. Saxena's view is supported by analysts. "An IPO is hardly going to help. To begin with, BSNL is sitting on huge cash reserves, so it's not like it's a cash-starved company. Basically it will not address the cause of its problems," says Neeraj Jain, director of transaction services at KPMG International .

There are, however, some clear advantages to BSNL of an IPO. A stock listing would give it more visibility in the international market, which could help the carrier with any potential international acquisitions.

And though BSNL has plenty of cash, notes Harit Shah, IT and telecom research analyst at Karvy Stock Brokers Ltd., an IPO would help make the operator "more transparent" and would "go a long way in making it accountable."

BSNL's revenues and profits have been on the decline for the past three financial years. In 2005-2006, the carrier reported revenues of INR401.8 billion ($8.75 billion) and net profit of INR89.4 billion (1.95 billion), but by 2008-2009 its revenues had slipped to INR358.1 billion ($7.8 billion), and its profits had slumped to INR5.75 billion ($125 million).

And with the increasing pressure on the financial performance of all of India's operators, caused by intensive competition and the introduction of per-second billing, it's possible BSNL might not make a profit during the current financial year, which ends in March 2010.

The carrier has also been found wanting during the past few years of breathtaking mobile market growth: The Indian mobile market added 113 million new mobile lines in 2008, and is likely to have added more than 160 million in 2009, but BSNL's privately held rivals have been more reactive to the market and have grown more quickly.

BSNL is now only the fourth largest mobile operator in India, with more than 60 million customers, and in danger of slipping to fifth. Yet only a few years ago it was the No. 2 player behind Bharti Airtel Ltd.

BSNL hasn't even been able to capitalize on its advantage in the 3G market. Along with fellow state-owned operator Mahanagar Telephone Nigam Ltd. (MTNL) , BSNL was handed 3G spectrum more than a year ago, while India's remaining mobile operators are still waiting for their chance to take part in the proposed spectrum auction.

Yet after nearly a year of service, BSNL has just 600,000 3G customers, and it's now investing further in its 3G capabilities in the hope of reaching 1 million 3G users by March this year.

BSNL's situation has been made worse by its problems in adding new capacity to its GSM mobile network. The operator has been mired in legal wrangling over significant contract awards, with the latest tender for 93 million new mobile lines still in limbo.

"If BSNL had been able to get new equipment, it would have done much better than the other players in the market, since it has the best reach," believes KPMG's Jain.

Despite this, the operator has significant network assets. It has an optical transport network of more than 400,000 kilometers, India's largest and most extensive, and a valuable asset in pursuing growth in rural areas. By comparison, Reliance Communications Ltd. 's optical transport network is 40,000km long.

"The only way [BSNL] can be saved is by growth. It has to come up with new products and services, which appeal to the market. It has to generate new revenue streams. The company has to find ways and means to upgrade equipment as well. Unless and until it expands its network, and gets government support [to achieve that], BSNL will not live," believes Dr. Saxena.
