2.. IIn tthe miinuttes iissued by tthe managementt siide on tthe meettiing off tthe wage negottiiattiion
commiittttee helld on 4--12--2009 ((whiich was supplliied tto tthe Sttaffff Siide on 7--1--2010)),, iitt was
rreporrtted tthatt tthe managementt siide sttatted iin tthe meettiing tthatt tthe allllowances werre allways
paiid ffrrom a prrospecttiive datte.. Butt tthiis sttattementt was nott att allll corrrrectt and was rreffutted by
tthe Sttaffff Siide iin tthatt meettiing,, alltthough iitt was nott rreporrtted iin tthe miinuttes..
3.. The absorrpttiion off Executtiives iin BSNL ttook pllace llatterr tthan tthatt off Non--Executtiives.. Butt tthe
datte off absorrpttiion and datte off iimpllementtattiion off IIDA pay scalles was 1--10--2000 on parr wiitth
Non--Executtiives.. Alltthough tthe absorrpttiion iin BSNL was agrreed by tthe Executtiives ttwo yearrs
llatterr comparred tto tthe non--executtiives,, and tthe orrderrs fforr rreviisiing ttheiirr pay scalles ffrrom CDA
tto IIDA werre iissued on 18--3--2004 onlly,, iin tthatt orrderrs iitt was prrescrriibed tto pay HRA fforr tthem
on rreviised pay wiitth effffectt ffrrom 1--10--2000 iittsellff on parr wiitth non--executtiives.. Thus tthe HRA
on rreviised pay was paiid fforr BSNL executtiives rrettrrospecttiivelly,, ffrrom a datte morre tthan 3 yearrs
befforre tthe datte off tthe orrderr.. The Agrreementt fforr rreviisiion off Perrks and allllowances fforr BSNL
Non--Executtiives was siigned on 14--2--2005 wherreas tthe datte off effffectt was rrettrrospecttiive ffrrom
1--1--2005.. IIn case off BSNL Executtiives tthe orrderr fforr rreviisiion off perrks and allllowances was
iissued on 23--8--2006 wherreas tthe datte off effffectt was rrettrrospecttiive ffrrom 1--1--2005,, on parr
wiitth Non--Executtiives.. Thus when tthe absorrpttiion as wellll as rreviisiion off perrks and allllowances
ttook pllace fforr executtiives llatterr tthan tthatt off non--executtiives,, tthe datte off effffectt fforr executtiives
was rrettrrospecttiive,, on parr wiitth non--executtiives.. Therre was no diiscrriimiinattiion agaiinstt tthe
Executtiives on botth occasiions.. Thiis was tthe corrrrectt sttand..
4.. Therrefforre when tthe HRA,, Allllowances and perrks arre rreviised now ffiirrstt fforr tthe executtiives,, iitt iis
nott prroperr on tthe parrtt off BSNL managementt tto ttrry tto diiscrriimiinatte agaiinstt tthe non--
executtiives by makiing iincorrrrectt sttattementts tthatt tthe allllowances arre paiid allways ffrrom a
prrospecttiive datte onlly.. The ffactts dettaiilled iin parra 3 above and iin tthe parra 13 bellow cllearrlly
esttablliish tthatt tthe sttattementt off tthe Offffiiciiall Siide tthatt allllowances arre allways paiid
prrospecttiivelly,, iis nott corrrrectt.. IInsttead off ttrryiing tto deny tthe due beneffiitts tto tthe non--executtiives
on tthe basiis off such iincorrrrectt sttattementts,, iitt shoulld be tthe dutty off tthe managementt tto see
tthatt tthe same datte off effffectt iis iimpllementted fforr non--executtiives wiitthoutt any diiscrriimiinattiion..

settttllementt shallll be effffecttiive ffrrom 1st Januarry 2007 and wiillll be rreviised as and when wage
rreviisiion off executtiives ttakes pllace””.. IIn parra 2..5 off tthiis drrafftt iitt was menttiioned ““ The house
rrentt allllowance tto tthe non--executtiive emplloyees off BSNL wiillll be att tthe ffollllowiing rrattes and
wiillll be payablle on rreviised pay::--””These ttwo cllauses rread ttogettherr mean tthatt tthe HRA as perr
tthe rreviised rrattes has tto be paiid on rreviised pay wiitth effffectt ffrrom 1--1--2007.. Butt tthe
underrsttandiing rreached iis tthatt tthe rreviised rrattes off HRA arre tto be paiid on rreviised pay wiitth
effffectt ffrrom 27--2--2009 onlly and nott earrlliierr.. Hence iin tthe amendmentts prroposed by us tto tthe
drrafftt tthiis was menttiioned and managementt siide diid nott diisputte iitt..
6.. When tthe DPE ciirrcullarr datted 26--11--2008 prrescrriibed tthe same rrattes off HRA fforr allll tthe
emplloyees off CPSEs,, tthe same datte fforr affffecttiing tthese HRA rrattes on rreviised pay iis
applliicablle fforr botth Executtiives and Non--Executtiives wiitth outt diiscrriimiinattiion.. Keepiing tthiis iin
viiew,, Orrderrs werre allrready iissued by BSNL managementt viide 1--22//2009--PAT((BSNL)) datted
20--5--2009 fforr cllassiiffiicattiion off ciittiies and paymentt off rreviised HRA rrattes as prrescrriibed by
DPE,, fforr tthe non--executtiives allso,, wiitth effffectt ffrrom 27--2--2009.. Siince tthe pay scalles werre nott
yett rreviised fforr non--executtiives,, tthe rreviised HRA rrattes werre paiid iiniittiialllly on prre--rreviised pay
onlly,, wiitth effffectt ffrrom 27--2--2009.. IItt iis iimplliied tthatt tthese HRA rrattes arre tto be iimpllementted on
rreviised pay allso wiitth effffectt ffrrom 27--2--2009 once tthe rreviised pay scalles fforr non--executtiives
come iintto effffectt ffrrom 1--1--2007..

Executtiives have drrawn pay iin prre--rreviised scalle onlly,, and arrrrearrs off pay fforr tthe perriiod
Januarry 2007 tto Febrruarry 2009 werre paiid llatterr iin ttwo iinsttallllmentts.. Butt tthe rreviised rrattes off
HRA werre paiid on rreviised pay wiitth effffectt ffrrom 27--2--2009 alltthough tthey have nott drrawn
rreviised pay on tthatt datte.. Hence no diifffferrentt yarrdsttiick can be applliied fforr Non--Executtiives
now and tthe rreviised HRA rrattes can nott be rresttrriictted tto prre--rreviised pay on 27--2--2009..

13.. Ottherr PSUs have iimpllementted tthe same datte off effffectt fforr Executtiives and Non--Executtiives
wiitthoutt diiscrriimiinattiion and iitt was rrettrrospecttiive fforr Non--Executtiives.. IIn tthe Food Corrporrattiion
off IIndiia tthe Agrreementt was siigned on 9--11--2009 wherreas tthe datte off effffectt fforr HRA and allll
allllowances was ffrrom 1--12--2008.. IIn tthe ECIIL,, tthe Agrreementt was siigned on 24--9--2009
wherreas tthe datte off effffectt fforr HRA on rreviised pay was wiitth effffectt ffrrom 26--11--2008.. IIn
BHEL tthe Agrreementt was siigned on 30--12--2009 wherreas tthe HRA,, allllowances and perrks
werre rreviised wiitth effffectt ffrrom 26--11--2008..

diiscrriimiinattiion agaiinstt tthem wiillll amountt tto addiing ffuell tto tthe ffiirre.. IItt wiillll llead tto a serriious
iindusttrriiall unrrestt.. Therrefforre iitt iis rrequestted tto kiindlly iintterrvene so tthatt tthe datte off effffectt fforr
iimpllementtiing tthe HRA,, allllowances and perrks on rreviised pay fforr non--executtiives iis acceptted
as 27--2--2009 on parr wiitth executtiives wiitthoutt any diiscrriimiinattiion.. We shallll be tthankffull fforr
