09.06.2010 : Joint Action Committee (JAC) Meeting : JAC leaders met today to discuss and analyse the status of demands / assurances given by Hon'ble MoC&IT in the meeting held on 20.04.2010 during Indefinite Strike. JAC after detailed discussions and analysing the actions taken by DOT / BSNL expressed its serious dissatisfaction that there is no seriousness in DOT for the redressal of the JAC demands and on the assurances given by Hon'ble MoC&IT. Even after a lapse of 1 month and 20 days period the Cabinet Note on IDA pension revision and ITS officers' absorption issues has not been prepared and circulated to nodal ministries, whereas the assurance was given that within one month period the Cabinet Note on both the issues will be sent for inter-ministerial circulation and thereafter within 2-3 months Cabinet approval will be taken.

The 78.2% IDA fitment benefit instead of 68.8% as per DPE OM dated 02.04.2009 has not been implemented by BSNL Management, despite the assurance given by the Hon'ble MoC&IT. Issue is being dragged by forming a committee.

The assurance given by Hon'ble MoC&IT for the procurement of 10 million GSM lines immediately has been reduced to 5.5 million GSM lines by BSNL Board which will adversely affect the growth of BSNL and its viability.

BSNL Management has promptly paid 3G spectrum charges to DOT Rs. 10,186.56 Cr. without showing any resistance and request for deferred payment in view of the continuous decline of BSNL's profit and is now ready to make the payment of WiMAX and Broadband about Rs. 9000 Cr. BSNL Management ignoring the protest of JAC and without bothering the BSNL's financial health is trying to exhaust the BSNL reserves. It was seriously viewed and JAC demanded that 3G spectrum charges should immediately be refunded to BSNL and may be taken as deferred payment on yearly basis and further WiMAX/Broadband license fee charges should be paid only on deferred payment basis.

JAC demanded that Govt. of India should issue instructions / order to all Central / State Govt, departments and PSUs to take telecom services compulsorily from BSNL / MTNL only and also should allow BSNL to procure equipments on competitive rates from the suppliers / vendors on international security standards irrespective of technology.

On the above issues, JAC unanimously decided to resort immediate trade union action programmes i.e. Massive Demonstration on Monday, 14th June 2010 during Lunch / Closing hours and Mass Dharna for one day on Wednesday, 16th June 2010 at BSNL Corporate Office, all Circle / SSA HQs. All the Circle / Branch Secretaries are requested to ensure successful implementation of Agitation Programmes. Future course of action will be decided by JAC shortly.

08.06.2010 : GS, President along with CHQ office bearers at New Delhi met PGM (FP) and discussed :

(a) Unjust mass transfers of AOs & CAOs- We expressed our serious resentment against mass transfer orders of AOs / CAOs issued on pick & choose method in violation of BSNL Executive transfer policy. The AOs / CAOs having 57-58 years age have been transferred to distant Circles in large numbers from the Circles on the pretext of long standing and equalisation of vacancies in Circles. We pleaded that we are not against transfers to consider the request transfer cases as well as to fill up some vacant posts of deficit Circles but that should be strictly as per the guidelines of BSNL Executive transfer policy. We demanded to revise the transfer orders as per the transfer policy. PGM (FP) after detailed discussions assured to examine the objections raised by the associations.

(b) Consideration of pending request transfers of JAOs/ AOs/ CAOs- We expressed our serious concern against non consideration of pending request transfers of JAOs/ AOs/CAOs. PGM (FP) mentioned that all pending request transfer cases are being examined and will shortly be processed.

08.06.2010 : GS, President along with CHQ office bearers at New Delhi met Director (HR) and discussed :

(a) DPCs from SDE(T) to DE (Adhoc) and DE(Regular)- We expressed our serious concern against delay in completing the process of DPCs from SDE(T) to DE (Adhoc) and DE(Regular). We requested that the DE promotion orders on regular and adhoc basis should be issued before 30th June-2010. So that further ACRs / VCRs are not required. We also resented that for DE regular promotion ACRs of the year 2002 onwards have been again called for by GM (Pers) which will delay the DPC process. It is under stood that the ACRs screening work for DPCs of DE regular and adhoc was already completed by the committed headed by GM(Pers ) and now again repeating the same exercise will further delay the DPC process. We requested that at this belated stage the change of DPC members is not justified. Dir(HR) assured to look into the matter.

07.06.2010 : GS, AGS (HQ), AGS (F) met GM (Pers) and discussed :

(a) DPC from SDE (T) to DE on adhoc and regular basis : We requested to complete the DPCs from SDE (T) to DE on adhoc and regular basis. GM (Pers) mentioned that both the DPCs of DE on adhoc and regular basis are under process. The necessary feedback has been provided to the DPC members. The DPC members have prepared a checklist and have asked some clarification which are being clarified shortly. This may delay the process. We expressed our dissatisfaction against delaying the DPC on one or the other pretext.

(b) DPC from JTO (T) to SDE (T) : We expressed our serious concern against delay in conducting the DPC from JTO (T) to SDE (T). GM (Pers) informed that the DPC from JTO (T) to SDE (T) is held up due to incomplete data received from 16 Circles as required in 9 annexures to decide All India seniority of eligible JTOs i.e. A&N, UP (W), JKD, KRL, NE-II, UP (E), BBNW, WTP, BR, MH, NTR, RJ, WB, NE-I, ETR & ITP. All the concerned Circle Secy�s are requested to ensure early dispatch of required information.

(c) Declaration of final eligibility list of JTOs allowed to appear in LDCE of TES Gr. B being held on 4th July 2010 : GM (Pers) informed that some JTOs of 2005, 2007 and 2009 have filed case in Delhi PB CAT for allowing them to appear in LDCE being held in July 2010. The hearing in the case is taking place on 08.06.2010. Thereafter only the position in this regard will be clear.

07.06.2010 : GS writes regarding request transfers in the cadres of DGM (F), CAO/AO/JAO, DE (T), EE, SDE (T).
03.06.2010 : JAC writes :

Letter-1 : To Hon'ble Prime Minister of India forwarding resolution on waiver of 3G Spectrum, WiMax and Broadband charges for BSNL.

Letter-2 : To Secy (T) regarding removal of anomaly in pension for those retired during Oct 2000 to July 2001.

Letter-3 : To CMD BSNL regarding grant of 78.2% IDA w.e. from 01.01.2007.

Letter-4 : To Secy (T) regarding IDA pension revision for BSNL absorbees retired before 01.01.2007.

Letter-5 : To CMD BSNL regarding procurement of 10 million mobile lines.

03.06.2010 : GS spokes to GM(Pers.) & discussed:-
(a) DPC from SDE(T) to DE - We requested to complete DPC from SDE(T) to DE before 30th June'2010 and discussed the status of court case in Hon'ble CAT Chandigarh in this issue. GM(Pers.) mentioned that sincere efforts are being made to complete the DPC at the earliest.

(b) Consideration of Pending request transfer cases of SDEs/DEs- We requested for early consideration of pending request transfer cases of SDEs/DEs. GM(Pers.) assured to look into the matter.

(c) Posting of SDE(T) in NE-II Circle on the stations declared for One Year tenure- We apprised GM(Pers.) that some SDEs requested to NE-II Circle for one year tenure posting have been posted by CGM NE-II Circle to Arunachal Pradesh & other stations having two years tenure is not justified. GM(Pers.) assured to look into the matter.

03.06.2010 : Status of Court Case against Promotion from SDE(T) to DE:- Hon'ble CAT Chandigarh Case no. 392 filed by SC-ST Welfare Association, J & K Circle Vs. Union Govt. of India- Case was listed for hearing at S.No. 24 on 03.06.2010. The applicant Advocate pleaded that the Promotion Rules should be followed while making promotion from SDE(T) to DE. BSNL Advocate agreed for it. The case is posted for hearing on 13.08.2010. Com. Kamlesh Dadwal, Circle Secy., Punjab Circle alongwith other affected members was also present during the hearing. AIBSNLEA will shortly impeded in the case.
