BSNL listing only after financial performance improves: Govt

NEW DELHI: The government has made it clear that it will not go public with state-run BSNL until the financial performance of the telecom PSU improves.
"The issue of listing would be taken after the performance of BSNL improves to get the right valuation and after obtaining the views of different stakeholders, like staff union and associations," DoT said in a reply to queries sent by Public Accounts Committee on performance of BSNL.
The disinvestment in BSNL will pave the way for the IPO and consequent listing on the stock exchanges.
BSNL has posted its first ever net loss of over Rs 1,822 crore in the last financial year from a net profit of over 574 crore in 2008-09 and over Rs 10,183 crore in 2004-05.
Prime Minister Manmohan Singh had constituted a committee headed by Sam Pitroda to look into the reasons for BSNL's poor performance and suggest ways to improve it.
The Pitroda panel had suggested among other things, 30 per cent disinvestment in the telecom PSU.
The proposal met with stiff opposition from the employees' unions and associations of BSNL, which were against any move to offload government's equity in the company.
Meanwhile, DoT has constituted an internal committee headed by Member (Services) to look into the recommendations of Sam Pitroda panel and give its report after taking inputs from BSNL management and employee associations.
BSNL, which has been facing competition from private players, saw its market share (GSM and WLL) declining to 11.44 per cent in June 2010 from 15.64 per cent in March 2008.
The case of granting Navratna status, under which cash-rich PSUs are given a certain autonomy with regard to investments and other financial transactions, to BSNL will also be considered only after its listing.
The apex committee under chairmanship of Cabinet Secretary in its meeting held in July 2008, had made the listing of Central PSUs a pre-condition for granting Navratna status.
Besides disinvestment, Pitroda commitee also suggested voluntary retirement to over one lakh staff as part of steps to improve BSNL's financial health.

The National JAC which met on 23-09-2010, at New Delhi, reviewed the preparations for the strike which is to take place on 19th to 21st October, 2010. As per the reports received, the conventions conducted in various circles have evoked great enthusiasm among the employees. However, due to the assembly elections in Bihar and Local Body elections in Kerala, a demand has come from those circles to reschedule the strike dates. Considering the importance of the elections, the JAC decided to reschedule the strike dates. Accordingly the strike will now take place on 24th, 25th and 26th November. Further, the JAC has also decided to conduct a march to the parliament on 11th November, 2010. Circle, District and Branch secretaries are requested to make note of the changes and act accordingly. Fullest mobilization may be started both for the march to the Parliament and for the strike in November.

[18.09.2010]5th Membership Verification – Some feel helpless and frustrated
The time schedule for 5th membership verification has just been finalized. However, by this time some have already started feeling helpless and frustrated. Out of frustration they have started abusing us and the stand that we took in the all union meeting held on 16.09.2010.
In the all union meeting, held on 16.09.2010 with the management, some unions demanded that the Code of Discipline should be given up and BSNL should frame it’s own Recognition Rules. As far as we are concerned, we cannot take a decision on such a serious issue, without consulting our Circle Secretaries and CHQ office-bearers. So, we informed the management that we could convey our decision on this issue, only after discussion in our Central Executing Committee which is going to meet from 27th to 29th September, at Nagpur. Management said that they could not wait till such time and announced that the 5th membership verification would take place on the basis of Code of Discipline.
Some unions opposed this decision of the management and walked out of the meeting, declaring that they would boycott the 5th verification, if it is conducted on the basis of code of discipline.
As far as we are concerned, we have confidence on the workers. We are ready to face the election either based on the code of discipline or based on the Recognition Rule to be framed by the management. All that we want is some time to take a democratic decision at the appropriate forum. But some don’t have confidence on workers. They require the mercy of the management to run their show. When they did not get help from the management, they have become frustrated and abuse us. We can’t help them.
[17.09.2010]Supreme Court issues notices on 2G Spectrum scandal
On the Multi Crore Spectrum scandal, the Supreme Court has issued notices to the CBI, the Telecom Minister, Income Tax Department and the Enforcement Directorate. The notices were issued, based on a Public Interest Litigation, filed by an NGO. The petitioner has alleged that the DoT had given away 2G Spectrum to 122 operators, at a throwaway price of Rs.1,658 crore for a pan-India license on a first-come-first-served basis, in January, 2008. The court has directed that the reply should be given within 10 days.

The issue of revision of pension of Pre-2007 BSNL retirees was discussed with Shri S.C. Misra, Member (Services), Telecom Commission on 16.09.2010. He informed that he has already reminded Secretary, DPE regarding the issue. Once the file is received back, after approval by the Communications Minister, the cabinet note will be forwarded to government for approval.

[16.09.2010]All union meeting with BSNL management on 5th Membership Verification
BSNL management had called for an all union meeting to discuss about the 5th Membership Verification. The meeting took place today (16.09.2010). Com. V.A.N. Namboodiri, President and Com. P. Abhimanyu, GS, represented BSNLEU in the meeting.
In the meeting, some unions proposed that BSNL should give up the Code of Discipline and should frame it’s own “Recognition Rules”, based on which the 5th verification should take place. BSNLEU took the position that introducing of BSNL’s own Recognition Rules was a serious matter and that the same could not be accepted without discussing it in the Central Executive Committee of the union.
Thereafter, management announced that 5th verification would be held on the basis of Code of Discipline only. Protesting this, some unions like NFTE, FNTO etc., walked out of the meeting. They also declared that they would be boycotting the 5th verification, if it is conducted based on the Code of Discipline. However, the meeting continued and the time schedule for conducting 5th verification was finalized. The following is the time schedule for 5th Membership Verification.

[14.09.2010]Delay in the implementation of NEPP- Circle and District Secretaries to note please.
It is learnt that the process of implementation of the Non Executive Promotion Policy (NEPP) has not at all started in many districts. It seems that there is a wrong understanding at the field level that this process can be started only after the expiry of the last date for giving options, i.e., 22-10-2010.If the process starts only after 22-10-2010,then there will be great delay in giving promotions to the officials. This is undesirable. At the intervention of the CHQ, BSNL CO has already issued order to implement the NEPP at the earliest. (Lr.no.27-7/2008-TE dated 06-09-2010) Hence, Circle and District Secretaries are requested to ensure that all officials give their options immediately and also to ensure holding of DPC etc. without further delay.

[10.09.2010]Meeting held on 09-09-2010 by Member (Services), DOT with Joint Action Committee of Unions / Asssociations of BSNL Non – Executives / Executives on Sam Pitroda Committee Recommendations.
Shri S.C . Misra, Member (Services) DOT and the Chairman of the Committee appointed by the Telecom Commission to examine and give its recommendations on implementation of the Sam pitroda committee Report on BSNL, held a meeting with the JAC of BSNL Unions/Associations on 09-09-2010 at 15-00hrs, in Sanchar Bhawan.
The JAC submitted its views on the recommendations of Sam Pitroda committee. Discussion took place on the points submitted by JAC. The JAC strongly opposed disinvestment, VRS/Transfer of one lakh employees, unbundling, formation of subsidiary for cell towers, formation of subsidiary for developing vacant land of BSNL in collaboration with a Real Estate company etc. . The JAC told Shri. S.C. Misra that BSNL should be not only considered as a commercial organisation but also as a PSU having social responsibility and as an instrument in the hands of the Government to fulfill its social obligations. The JAC demanded that the Government should suitably compensate BSNL financially, for incurring losses while fulfilling social obligations.
Shri. S.C. Misra told that the meeting helped him in understanding the view point of workers. He further asked the JAC to submit additional note on issues like reimbursement to BSNL for fulfilling social obligations, business plan to utilise the local copper cable in best possible manner in case unbundling is not wanted, etc.
However, we should prepare for serious struggle in order to defeat the anti BSNL policies of the Government. We should make the JAC call for 3 days strike from 19-10-2010 to 21-10-2010 a grand success, in order to protect BSNL and our future.
Com. VAN Namboodiri ( Convenor JAC & President BSNLEU) and Com. P.Asokababu ( Dy. General Secretary BSNLEU) represented BSNLEU in this meeting. Com. P. Abhimanyu General Secretary, BSNLEU was out of station to attend the Circle Conference of Andaman & Nicobar circle.
[09.09.2010]Pension Revision – Leaders met DOT officers:- Com. VAN Namboodiri (President BSNLEU & Adviser AIBDPA ), K.G. Jayaraj ( General Secretary, AIBDPA) and P. Asokababu ( Dy. General Secretary BSNLEU ) today met concerned officers of DOT and pressed for early settlement of pension revision of pre 2007 BSNL retirees. Shri. S.C. Constituents of the JAC presented their views on the recommendations of the Sam Pitroda Committee, to the BSNL management, on 06.09.2010. The unions and Associations affiliated to the JAC opposed tooth and nail, disinvestment including sale of 30% share to a strategic partner, reduction of one lakh staff strength through VRS and unbundling of BSNL’s copper cable. Demonstrations were held today throughout the country to make 7th September strike a grand success. The Deputy Chief Labour Commissioner (Central) held conciliation proceedings today between the BSNL Management and BSNL Employees Union. The representative of the management submitted in writing that the demands in the strike notice given by BSNL Employees Union were concerned with the policies of the government, and BSNL management was not in a position to settle them. Further the management requested the union to withdraw the strike on 7th September, 2010. The union representative told that the demands for the strike were the common demands raised by all the trade unions in various sectors in the country and the govt. so far did not come forward to settle this demands and hence the strike would be there on 7th September, 2010. Since General Secretary Com. P. Abhimanyu was at Pune to attend the JAC convention, BSNL Employees Union was represented by Com. P. Asokababu, Dy. General Secretary and Com. R.S. Chauhan, Org. Secretary. Make all out efforts to see that the 7th September general strike is a grand success in BSNL. As in BSNL, the Central Govt. Employees, the State Govt. Employees, the Public Sector Employees, the Employees of Banks, Insurance and the workers in all sectors will participate in this general strike on 7th September, 2010. The acute shortage of 3G data cards in Tamil Nadu Circle, on which BSNLEU, Tamil Nadu Circle conducted demonstrations on 30.08.2010, was brought to the notice of the CMD, by the staff side secretary in today’s National Council meeting. CMD contacted the concerned officers and took immediate action. Thereafter, CMD informed the house that 1500 data cards are already diverted to Tamil Nadu Circle and another 3000 data cards would be diverted within 5 days. He also assured that immediate action would be taken to overcome the short supply of 3G data cards.

Tamil Nadu Circle Union conducted demonstrations yesterday, the 30.08.2010, in all the Districts, demanding the management to immediately supply 3G data cards. Workers have participated enthusiastically and in large numbers in all the districts. It is reported that there is a great demand for BSNL’s 3G data cards from the general public. However, this is in short supply in all the districts. As a result, hundreds of customers have applied for this service and are put on waiting list in each and every station. On one side the BSNL management makes sermons to the workers to work hard to improve the services. On the other side when workers are prepared to work the management is incapable of making timely supply of necessary equipments. [21.08.2010]Clarifications issued by BSNL CO on Non-Executive Promotion on Policy (NEPP) – some questions and answers
Question No.1: In which way the clarifications issued on 20.08.2010 are going to be beneficial to the employees?
No.1: The demand of our union that the employees should be given the option to get their pay fixation done on the date of next increment, instead of the date of promotion has been accepted. This clarification will benefit a large number of employees.
No.2: Eventhough the order on Non-Executive Promotion Policy was issued on 23.03.2010 itself, the same has not been implemented in most of the circles for the past 5 months. Because almost all the CGMs had sought clarifications from the Corporate Office and the same were not issued. The Corporate Office was sleeping on the files. Thus, the United Forum gave call for agitations on 5th and 12th August, 2010. Thereafter the Corporate Office woke up and has now issued the clarifications. Some of the clarifications are not acceptable to us, which will be duly taken up with the management. However, based on these clarifications employees will be getting promotions immediately, as per NEPP.
Question No.2:Why the modifications sought for by our union are not accepted and included in the clarifications issued on 20.08.2010.
Reply: Our union has sought many modifications to the NEPP, to give more benefit to the employees. These modifications are to be taken up for discussion in the forth coming meeting of the National Council to be held on 31.08.2010. Nevertheless, these modifications were discussed with the management, in the talks held on 09.08.2010. Since the issues require more discussion, both sides agreed to discuss them further in the National Council meeting.

[20.08.2010]News from DoT
9200 scale cleared by DPE: - The NE 12 scale (9200) of the Non-Executive Promotion Policy has been sent for the approval of the Department of Public Enterprises (DPE). It is now learnt that DPE has cleared the file and sent back to the DoT. It is also learnt that the DPE has informed that the 9200 scale should not be in conflict with the Executive / Non-Unionised Supervisor’s scale. Now the BSNL Board has to take decision on this issue.
IDA Pension Revision:- The cabinet note approved by the Minister has already been referred to the DPE, Pension Department, Expenditure Department and Law Ministry for their comments. The comments from these Departments are yet to be received by DoT. On 17.08.2010, the DoT authorities assured BSNLEU to issue reminders to these 4 departments for sending their comments immediately.

In continuation of the talks between BSNL management and the United Forum yesterday, it was assured by the management today, that the order on Anomalies will be released before the forthcoming meeting of the National Council.
Thereafter a meeting of the United Forum took place. The meeting reviewed the discussions that took place with the management yesterday as well as the assurance that is given by the Management today. The United Forum meeting welcomed the decision of the management on the anomaly issue and expressed it's satisfaction on the improvements on issues and unanimously decided to defer the Dharna that is scheduled to take place on 12-08-2010. CHQ expresses it's hearty thanks to the constituents of the UF, as well as to all our Circle, District and Branch Unions for their mobilisation done for the agitational programme which has made the settlements possible. The National Council Meeting which is to take place on 27-08-2010 has now been postponed to 31-08-2010, on our request.

The Note on Pension Revision of BSNL absorbed employees who retired before 01.01.2007 has been submitted by DoT to Communications Minister. The tremendous sacrifices made by the Central Government Employees in organizing that strike and what that strike achieved and how it changed the history of Trade Union movement and the necessity for struggles now to retain the rights achieved due to the 1960 strike and other struggles and sacrifices were detailed by the Leaders who addressed the Convention. Leaders from Railways. Comrades Umraomal Purohit (Railways), Rakhal Dasgupta (Defence-Civil), S.K.Vyas(Audit), Com V.A.N.Namboodiri and Pabitra Ranjan Chakraborty(Telecom) and several other leaders who lead and participated in the 1960 strike were falicitated. The house paid respectful homage to the martyrs who lost their lives due to Police firing during the 1960 strike.

[13.07.2010]National Convention by JAC at New Delhi on 19-07-2010.
As part of the nation wide campaign to save BSNL, a national convention is being held at New Delhi, on 19-07-2010, by the Joint Action Committee of BSNL unions and Associations. This is already intimated to the circle unions. The convention will take place in the Mavlankar Hall between 1000 hrs to 1400 hrs on 19-07-2010. Leaders of the Central Trade Unions, prominent MPs and leaders of the BSNL Unions and Associations will address the convention. As already intimated, all the circle unions are requested to send their representatives. Nearby circles, ie., UP (West), Haryana, Rajasthan and Punjab are requested to send delegates, as per quota already allotted to them. All the delegates are requested to take their seats in the hall latest by 0930 hrs.

[09.07.2010]Stand as one man to defeat the Pitroda Committee’s recommendations
The Telecom Commission has decided to form an internal committee to study the report of the Sam Pitroda Committee’s report. This committee will be headed by Shri S.C.Misra, Member (Services) of the Telecom Commission. It may be recollected that the Sam Pitroda Committee recommended cancellation of BSNL’s 93 million line tender. The BSNL Board immediately acted on this recommendation and has already cancelled the tender. This cancellation has aggravated BSNL’s capacity crunch and has done irreparable damage to BSNL. The Pitroda Committee has also recommended 30% sale of BSNL’s shares to a strategic partner as well as retrenchment of one lakh employees through VRS. Thus, it is needless to say that the Pitroda Committee’s recommendations should be thrown away lock stock and barrel. The JAC will closely monitor the developments. If necessary we will stand as one man to defeat the recommendations of the Pitroda Committee’s recommendations.

[07.07.2010]78.2% IDA merger – JAC meets the committee – 06.07.2010
On 06.07.2010, the JAC leaders met the committee, which has been formed by the BSNL management to recommend on the 78.2% IDA merger. The JAC leaders vehemently argued for the immediate merger of 78.2% IDA, w.e.f. 01.01.2007 for both the Executives and the Non-Executives. The management side members accepted that 78.2% IDA merger is fully justified for the employees. However, they stated that the financial position of the company was not satisfactory for making the payment. But the JAC leaders told in no uncertain terms that management has no other option but to make the payment immediately.

The JAC meeting took place on 06.07.2010 under the chairmanship of Com. Prahlad Rai, GS, AIBSNLEA. Almost all the General Secretaries of the constituent unions and associations participated in the meeting. The meeting reviewed the post card campaign and decided to extend the last date for posting till 19.07.2010. The JAC meeting reviewed the preparations of the National Convention to be held at New Delhi on 19.07.2010 and took decisions to effectively conduct the same. Apart from Com. V.A.N. Bharat Central Pensioners Confederation organized a National Convention and Dharna at Jantar Mantar, New Delhi, on 4th July, 2010. About 150 pensioners participated in it. Com. V.A.N. [25.06.2010]Meeting with Honb’le MoC & IT Shri A.Raja - As decided in the JAC meeting held on 23-06-2010, at New Delhi, leaders of the JAC met the Hon’ble MOC&IT, Shri A. Raja at Coimbatore today. Com. V.A.N. Namboodiri, Convenor, JAC, and General Secretaries Com. P.Abhimanyu, (BSNLEU), Com. G.L. Jogi (SNEA), Com. Prahalad Rai (AIBSNLEA), Com. V. Subburaman (TEPU) and others were present. Even before meeting the Hon’ble MOC, JAC leaders came to know today morning, that BSNL has already paid Rs.8313 crore towards BWA spectrum charges yesterday evening itself. As such, JAC leaders strongly pleaded to the Hon’ble MOC that BSNL’s spectrum charges should be reimbursed. In reply, Hon’ble MOC assured that he would strongly take up the issue with the Prime Minister and the Finance Minister. JAC leaders also brought to the notice of the Hon’ble MOC that there is no much progress in those issues on which assurances were given to the JAC, at the time of the April 20th indefinite strike. Hon’ble MOC assured that all these issues could be reviewed shortly, on his returning to New Delhi. The National JAC will also meet within a day or two at New Delhi and decide about further course of action.

[17.05.2010]A landmark All India Conference
The 5th All India Conference of BSNL Employees Union, which was held in “Jyothi Basu Nagar” at Thiruvananthapuram, from 12th May, 2010, came to an end on 15th May, 2010. Even though more than 3000 delegates, observers and visitors participated in the conference, it took place in the most disciplined manner. Fruitful discussions took place on important issues concerning the employees as well as the company, and resolutions are passed. Kerala comrades have made wonderful arrangements for the conference, which will be ever remembered and cherished by all those who attended. As a grand finale to the conference, election of office bearers was held. The election took place unanimously, keeping in mind the requirements of the organization. During his visit to Telecom Stores, Kolkata on 29.03.2010, Com. V.A.N. Namboodiri informed the meeting of the above decision. After the speech of General Secretary, Com. Adhir Kumar Sen, Circle Secretary, Telecom Store & CHQ Vice-President came forward and handed over an amount of Rs.10,000/- stating that this is only the advance payment and more amount will be collected after wage revision arrears payment and paid to CHQ. A meeting of the JAC was held today at New Delhi, at 1000 hrs, under the Chairmanship of Com. N.T. Sajwani. Representatives of all the unions and associations of the Non-Executives and Executives participated in the meeting. The meeting reviewed the discussions held with the Hon’ble Minister of Communications and CMD, BSNL on 16.04.2010. After taking all the aspects into consideration, the meeting came to a unanimous decision that the strike shall start as per the schedule. The indefinite stay out strike will start from 0600 hrs on 20.04.2010. All the CHQ Office-bearers as well as Circle, District and Branch Secretaries are requested to make all-out efforts to make the strike 100% successful.

[31.03.2010]Strike Convention at Kolkata:- A Convention to explain the demands and mobilize the workers for the Indefinite Strike from 20th April 2010 was held at CTO Conference Hall on 30th March 2010 at Kolkata. Hundreds of workers participated although the convention was held at short notice. A large number of comrades were sitting outside as the hall was overcrowded. The Convention was presided by the Circle Presidents of W.Bengal, Kolkata, Telecom Stores and Telecom Factory.
Comrades, Animesh Mitra, Saibal Sen Gupta, Adhir Kumar Sen, Om Prakash, Circle Secretaries of BSNLEU, Circle Secretaries of SNEA, AIBSNLEA, NUBSNLW, Com. Mihir Dasgupta, AGS, BSNLEU and other leaders addressed the Convention. Com. V.A.N.Namboodiri, Convener, Joint Action Committee and General Secretary, BSNLEU, explained in detail the demands of the strike and stated that the workers will jointly defeat the anti-worker policies of the government and the management.

[27.03.2010]JAC meets Hon'ble Minister of State for Communications Shri Gurudas Kamat :- The Hon’ble Minister of State for Communications, Shri Gurudas Kamat invited the leaders of the JAC for talks on 26.03.2010. The meeting took place at Sanchar Bhavan at 1100 hrs. BSNLEU was represented by Com. V.A.N. Namboodiri, General Secretary and Com. P. Abhimanyu, Dy. General Secretary. The issues contained in the strike notice served by the JAC were discussed.
At the outset the Hon’ble Minister stated that he was a votary of the Public Sector. He said that he wanted a strong BSNL so that the whole country need not depend upon the private telecom companies for communications.
The leaders of the JAC conveyed their strong opposition to IPO, VRS and Unbundling of last mile copper in BSNL. They urged upon the Minister to ensure uninterrupted equipment supply, immediate absorption of the ITS, revision of pension in IDA scales etc. In his reply the Hon’ble Minister stated that the issues raised by the JAC in it’s strike notice were receiving the attention of the govt. and that appropriate actions would be taken.
While we appreciate the gesture of the Hon’ble Minister of State, for inviting the leaders of the JCA for talks, within a few days of issuing the strike notice, we would like to inform our Comrades that he was not able to offer solution to any of the issues raised by the JAC. Hence, CHQ requests our Comrades to go ahead with the preparations for the indefinite strike in full swing and unleash a powerful campaign together with other constituents of the JAC to make the indefinite strike a success.
[19.03.2010]CITU Conference Supports BSNL Strike: - CITU Conference being held at Chandigarh from 17th March 2010 has extended its full support and solidarity to the strike of BSNL Workers proposed on 20th April 2010. Earlier, Com. V.A.N. [02.03.2010]Tamil Nadu Circle Conference delegates donate Rs.75,000/- for CHQ building fund:- The Tamil Nadu Circle conference is being held at the port city of Tuticorin, from 27th February to 2nd March,2010.
