3G Postpaid and Prepaid Data Service



3.1 Activation of Data Plans : SIM and Activation charges as applicable to 3G Postpaid & Prepaid voice plan will also be applicable for 3G data services.



(i) In place of existing FRC 120 for activation of 3G data plan, the following two new FRCs for activation of data plan are introduced.

i) The MRP of Data RCV is inclusive of Service Tax @10.30%. Circles can suitably adjust the MRP in the price band upto Rs.3 (+/-) of above price considering the technical feasibility.

ii) The validity in case of 3G prepaid RCV is 30 days. The RCV will increase both main account and dedicated account validity.

iii) The free minutes voice/video calls, SMSs and data usage offered with plan are to be consumed within the validity period. No carry forward of unutilized freebies are allowed.

iv) Free data usage is available while national roaming also. However, free voice/video calls & SMSs are available from home LSA only.

v) Other charges and usage beyond free limits will be as per normal call charges i.e. base voice plan under 3G service.

vi) In case of data plan the customers not purchasing data card from BSNL has to activate through FRC 120.

Making Contract Labour Act More Worker Friendly

Contract labour has become the order of the day given the compulsions of remaining afloat in a highly competitive environment due to globalisation. The employment structures are undergoing changes across the world with emphasis on flexibility in labour markets.

To meet the changing scenario many countries have embarked on amending labour laws to liberalize their respective labour markets. India too has been in it. The subject of contract labour figured prominently during the 43rd Indian Labour Conference where the Prime Minister Dr. Manmohan Singh said that this might be the time to ponder the wider issues. He said, ‘’We need to consider the role of some of our labour laws in contributing to rigidities in the labour market, which hurt the growth of employment on a large scale. Is it possible that our best intentions for labour are not actually met by laws that sound progressive on paper but end up hurting the very workers they are meant to protect?’’

The Contract Labour Regulation and Abolition Act, 1970 defines a contract labourer as a worker hired by principal employer of an establishment through a contractor for execution of a specific job. The Act makes certain welfare provisions like payment of minimum wages, certain health and sanitation facilities at the working place, provident fund benefits etc. for the benefit of contract labourers.


The Act applies to any establishment employing 20 or more workers on a contract basis on any day during the last one year. All contractors who employ or have employed 20 or more workers on any day of the preceding twelve months come within the purview of the Act. It is mandatory for such establishments to get registered as principal employers. Besides these regulatory provisions, government may prohibit employment of contract labour in any establishment or in any process/operation depending upon whether the work is perennial in nature or the work is incidental for an establishment. The Central Government on the recommendations of the Central Advisory Board has abolished contract labour system in a number of jobs in different industries and so far over 70 notifications have been issued. The Act provides for government inspections to detect violations.

Despite all these provisions, it has often been found that the law is under-protective for various reasons. First, as the contract labour is mostly in unorganised sector, it is hard for contract labourers to prove their identity as workers because the employer-employee relationship under the Act is blurred.


Secondly, to circumvent labour laws various kinds of employment structures have been created since globalisation reducing permanent jobs into non-traditional part-time, casual and contractual forms of employment. This has weakened job security and collective bargaining of workers.

According to the D.G., Labour Welfare “Contract Labour, by and large, is neither borne on pay roll or muster roll nor is paid wages directly. The establishments, which outsource work to contractors, do not own any direct responsibility in regard to their labourers. Generally, the wage rates to be paid and observance of working conditions are stipulated in agreements but in practice they are not strictly adhered to.”



It has also been observed in some developing countries that with contractualization of labour, social security of workers has suffered and workers are often terminated without benefits. Even the 2nd National Labour Commission said that at several of the centres it visited, it was found that in many cases contractors absconded after deducting social security contributions from the wages of contract workers leaving them high and dry.



Keeping in view the pressures of globalisation on establishments and the poor working conditions of the contract labour, the 2nd National Commission on Labour in its Report said that organisations must have the flexibility to adjust the number of workforce based on economic efficiency. It, however, recommended that contract labour should not be engaged for core production\services activities. The Commission further said that there have to be provisions prohibiting transfer of perennial core services to other agencies or establishments. It further recommended that the contract labour will have same remuneration as of a regular worker doing work of a comparable nature and the principal employer will ensure that the prescribed social security and other benefits are extended to the contract worker.



The Central Government has decided to amend the Contract Labour Act and has appointed a Task Force to make suggestions in this regard. Labour and Employment Minister M Mallikarjun Kharge said that the Act is being amended to ensure job security to workers and to check their exploitation. Conceding that outsourcing of labour has severely affected the workforce, Kharge said, “With employers resorting to outsourcing methods to a larger extent, the practice has dealt a severe blow to employees as they get lower wages.”



Before suggesting any amendments it would be incumbent upon the Task Force to examine that whatever little is ensured by the law is adhered to in practice. It has to bear in mind that contract labour and outsourcing have emerged as the prominent forms of employment. Therefore, the Task Force would have to balance between the flexibility in labour markets necessary in a competitive world, employment generation and job protection and social security benefits to workers.

The following targets are to be achieved during the month of Customer Delight Month:



Zero land line, OFC faults : All faults to be cleared on the same day



Zero Broad Band faults : Cable faults to be cleared within 48 hours



Zero Leased line faults



Zero BTS faults



Zero pending work orders of New Connections / Broad Band / shifting



Redressal of customer grievances in respect of quality of service, billing, stopping migration of customers



Visiting subscriber premises. Make the customers to learn using GPRS, through demonstration. This will enable the customers to avail value added services



Proper upkeep of the batteries and power plant



Identifying / disposing of scrap materials



Effective utilisation of the space which had been occupied by scrap materials



Maintaining punctuality - attending office on time



Manning of the Customer Service Centres from 8 am to 8 pm and on second Saturdays & Sundays



Giving proper publicity by issuing pamphlets to the public, displaying posters /flex boards and publicity through media. This is to give a message to the public that BSNL employees care for their customers



Each employee should bring at least 2 new customers (land line, Broad Band /Mobile etc.) during this month



To take all measures to save electricity



Weekly Review of the progress and discussion between management & Monitoring committee.

Union- was invited by the management for a discussion on VRS/CRS & recommendations of BRPSE on 20/04/2011. On behalf of the management Dir(HRD), Sr.GM(Estt), Sr.GM(SR), GM(Personal), GM(Restructuring) attended this meeting. The management put forth the following proposals for our consideration.

1. As per Rule-55 of BSNL CDA Rules-2006 employees who completed 55 years of age and could not perform duty due to ill health could be retired after recommending their cases to medical board.

2. As per Rule-55 of BSNL CDA Rules-2006 employees who completed 55 years of age and got 2 average CR entries could be retired after a show cause notice.

3. Employees who wish to go on voluntary retirement after completion of 55 years age may be permitted to retire voluntarily with full pension benefit for the remaining 5 years of service.

Since all the above proposals were aimed at reduction of staff by hook or crook, Union  rejected all these proposals and opposed the move of the management to implement the recommendations of both the Sam Pitroda committee and BRPSE indirectly.

Union calls upon all to be more vigilant to oppose and stop the retrenchment policy of the Management.

Dear comrades, as already intimated, the JAC has given call to observe an “Employees Awareness Week” from today, ie., 18-04-2011. It will continue up to 24-04-2011. As per the decision, combined general body meetings of all the unions and associations affiliated to JAC are to be conducted at SSA and branch levels. Ways and means to improve the quality of service as well as to improve the customer relations are to be finalized in these meetings. Similarly an action programme to be implemented during the “Customer Delight Month” is also to be finalized in these meetings. As per call of the Joint Action Committee of BSNL Associations/Unions of Executives and Non-Executives, BSNL workers all over the country organised protest demonstrations at lunch hour today, 05th April 2011 against the proposals of VRS, reduction in retirement age from 60 to 58 and merger of ITI with BSNL.

Hold demonstrations on 05.04.2011

against the retrograde recommendation of BRPSE



The JAC has already given call for holding protest demonstrations on 05.04.2011, against the recommendations of Sam Pitroda Committee to retrench one lakh employees through VRS. Now, the recommendations of the Board for Reconstruction of Public Sector Enterprises (BRPSE) has come. BRBSE has recommended.



(a) To introduce VRS in BSNL for retrenching the staff.

(b) To reduce the retirement age from 60 to 58.

(c) To merge the ITI with BSNL.

There is no doubt that the recommendations of BRPSE will ruin BSNL as well as the employees. Hence, JAC held on 29.03.2011 decided that protest demonstrations shall be conducted on 05.04.2011, against the above mentioned retrograde recommendations of BRPSE. Let us send a loud message to the government, through the protest demonstrations on 05.04.2011, that we will not accept the retrograde recommendations of the BRPSE.

The Central Executive Committee meeting of BSNL Employees Union is taking place at Chennai. The three day meeting will be held from 22nd to 24th March, 2011 at Rajiv Gandhi Memorial Telecom Training Centre (RGM TTC) at Meenambakkam in Chennai.



The meeting is taking place after the recent Himalayan victory in the 5th Membership Verification. Further, the first day of the CEC (22nd March, 2011) coincides with the 10th anniversary of the foundation of BSNLEU. So, naturally a lot of celebrations will be there in the CEC.



The CEC will be inaugurated by Com. A.K.Padmanaban, the All India President of The CITU. A seminar on the topic of “The present condition of BSNL and the ways and means to salvage it” will take place along with the CEC. Trade Union leaders and officers will participate in it. The CEC will review the results of the 5th verification. More importantly, the CEC will discuss and evolve a road map for restoring the profitability of the company. Thus, there is no doubt that the Chennai CEC will be a milestone.

Protest demonstration against VRS

¨ Protest demonstration against VRS on 05.04.2011

Telecom commission has called for the views of BSNL on VRS, as recommended by the Sam Pitroda Committee. To finalise it’s views, BSNL has constituted a committee. To convey the total opposition of the Non-Executives and Executives of BSNL, against VRS, the JAC has decided to conduct nation wide protest demonstrations on 05.04.2011.



¨ Settlement of pension revision

The issuing of pension revision order by the government is a great achievement of the JAC. At the same time, the JAC decided to write to the government to remove the condition that government’s pension liability is limited to 60% of the receipts from BSNL and MTNL. JAC also decided to write to the govt. that BSNL’s pension contribution should be based on the basic pay of the employee and not based on maximum of the scale.



¨ ITS absorption

Some constituents suggested that JAC should go to court based on the recent DOP&T’s order on over stay while on deputation. However, a decision on this is deferred. Meanwhile it was decided to write a letter to Secretary, DoT demanding to implement the said DOP&T order in respect of the ITS officers.



¨ NFTE & FNTO abstained from JAC meeting

NFTE and FNTO abstained from this JAC meeting also. It was decided to request them to come back to the meetings of JAC.




[17.03.2011]VICTORY OF ALL THE 3 CANDIDATES SUPPORTED BY OUR UNION IN THE MLC ELECTIONS IN ANDHRA PRADESH

All the 3 candidates (Sri M.V.S. Sarma, Sri Y. Srinivasa Reddy and Dr. Geyanand) supported by the progressive trade unions including our union have won as MLCs (Member of Legislative Council) from Graduates constituencies in Andhra Pradesh. The election was held on 13.03.2011 and counting was held on 15.03.2011. It is a victory of the organizational capacity of the trade unions in banks, insurance, telecom, postal, medical representatives, teachers, angenwadi workers and unorganized sector workers over the money power of the capitalist landlord candidates. This experience proves that working class can effectively intervene in bringing good changes in the politics. CHQ congratulates Andhra Pradesh Circle Union and all the progressive unions in Andhra Pradesh on this occasion.

In what can be termed as a major breakthrough, DoT issued order yesterday for pension revision for those who retired from BSNL prior to 01.01.2007. Until now there is no order for revision of pension in IDA scales. Due to the combined efforts of the JAC, BSNLEU and the AIBDPA, cabinet took decision for revision of pension on IDA scales. The United Forum meeting was held at New Delhi on 26.02.2011, under the chairmanship of Com. Suresh Kumar (GS, BSNL MS). Convenor Com. V.A.N. Namboodiri welcomed all and reported on the current developments. Representatives of BSNLEU, TEPU, BSNL MS, SEWA BSNL, NFTBE and FNTOBEA participated in it. BSNLEU was represented by Com. P. Abhimanyu, GS and Com. P. Asokababu, Dy. GS.



A new National Steering Committee is formed in the meeting with two members from each union. Members of the new Steering Committee are:-

It is emphasized that formation of such Steering Committees are very essential for the cohesive functioning of the alliance. March 15th is fixed as the ultimatum for formation of the Circle and District level steering committees as well as for finalizing of the nominations to the Local and Circle Councils. District and Circle Secretaries are requested to make note of this and implement the decisions meticulously.



[26.02.2011]Decisions of the United Forum Meeting held on 26.02.2011

United Forum meeting took place today the 26.02.2011. Com.Suresh Kumar (GS, BSNLMS) presided over the meeting. Convenor, Com.V.A.N. Namboodiri welcomed all. The representatives of BSNLEU, TEPU, BSNLMS, SEWA BSNL, NFTBE and FNTOBEA attended today’s meeting. A new National Steering Committee with two members from each union is constituted. Com.Suresh Kumar is elected as the Chairman and Com.V.A.N. Namboodiri is elected as Convenor of the National Steering Committee.



The Steering Committee reviewed the formation of Steering Committees at Circle and District levels. It was decided that Steering Committees wherever not formed, should immediately be formed by 15th March, 2011. The nominations for District and Circle councils should also be got approved in the Steering Committee by the 15th March, 2011. Circle and District Secretaries are requested to note this. They should ensure that nominations to District and Circle councils are approved by the concerned Steering Committee by 15th March, 2011.

[24.02.2011]CHQ requests BSNL management to allot sufficient funds

CHQ is receiving complaints from many circles that Corporate Office is not releasing sufficient funds for the payment of GPF, NEPP arrears etc. Com. P. Abhimanyu, GS, met the GM, BBF and discussed the issue. GM (BBF) said that due to shortage of cash, Corporate Office is not able to release sufficient funds to circles. GS explained the difficulties being faced by employees in this regard and requested to release sufficient funds on time.



[24.02.2011]Modifications to NEPP

The modifications sought by BSNLEU to the NEPP are yet to be accepted by the management. Com. P. Abhimanyu, GS, met the Senior GM (Estt.) today and discussed the issue. He insisted upon the management to immediately take decision. Sr.GM (Estt.) suggested that a full fledged discussion on these modifications could be held. General Secretary accepted this proposal. The tentative date for this discussion is fixed as 9th March, 2011.

ii) The proposals for nominations should be sent by post only. Nominations through fax will not be accepted as it leads to some problems.

Once again Circle Secretaries are reminded about the necessity to mobilise for the historic February 23rd March to the parliament. Many of the demands are directly concerned with the future well being of BSNL and it’s employees. Hence, all Circle Unions are requested to compulsorily send comrades for participation in the March to the Parliament. Circles nearer to New Delhi have the responsibility to make more mobilization. It has been decided in the United Forum National Steering Committee meeting, held on 07-02-2011, that steering committees should be formed at the Circle and SSA levels by 20-02-2011. Each union will have two members in the steering committee. Convenor of the committee will be from BSNLEU side. Nominations to the Circle Council and Local Councils should be first finalised in the respective steering committee and thereafter sent to the CHQ for approval. Formation of Circle and Local steering committees may be done by 20-02-2011. All Circle and District Secretaries are requested to make note of this and cooperate please.

[07.02.2011]Make widest mobilization for the 23rd February “March to Parliament” :- As a corollary to the 7th September, 2010 Nation wide strike, the Central Trade Unions and Industrial Federations have given call for a March to Parliament on 23.02.2011. This programme is against the anti people economic policies of the government, disinvestment & privatization of the PSUs, price rise, proposal to modify the Labour Laws etc. BSNL Employees Union is a party to the decision. Hence, all Circle Secretaries are requested to mobilize the workers for the rally. Especially, the Circles nearer to New Delhi are requested to make the maximum mobilization. This is a very important task and Circle, District Secretaries are requested to implement it with due seriousness.

[07.02.2011]Recognition after 5th membership verification :- Vested interests are spreading the rumour that BSNLEU would not be given recognition due to the Kerala High Court Directive. This is totally baseless. The Kerala High Court directive does not bar the management from granting recognition to BSNLEU. Com. P. Abhimanyu, GS, BSNLEU met the Senior GM (SR) today and discussed the issue. Sr.GM (SR) assured our General Secretary that recognition order will be issued. He also stated that the court directive is not a bar for granting recognition.

Himalayan Victory

BSNLEU has won the elections in BSNL for the record 4th time in a row. In the polling held on 1st February, 2011, BSNLEU has got 106971 votes. It has won the elections by a whopping margin of 26671 votes. BSNLEU has achieved this feat eventhough 18,000 workers have retired since the last verification. Despite forming a mega alliance consisting of nine unions, NFTE has once again bitten the dust. The workers have also taught a lesson to those ‘turncoats’ who enjoyed the fruits of the recognition till the last minute and thereafter started backbiting BSNLEU.

BSNLEU expresses it’s sincere thanks to the workers for the unflinching faith that they have reposed on it. BSNLEU also expresses it’s gratitude to the leaders and cadres who tirelessly worked for the past two months, for this historic victory. To mark this victory, CHQ calls upon the Circle, District and Branch Unions to celebrate victory day on 04.02.2011, by distributing sweets to all.

A PAPER FOR DISCUSSION ON VRS
a) Why we Oppose VRS?

WHY TRADE UNIONS OPPOSE VRS?

1. No trade union can accept VRS in principle
2. It is soft retrenchment by way of alluring employees.
3. Employees are sent out again to unemployed area.
4. VRS posts


can’t be kept vacant; it is once for all abolished affecting future employment…a Recruitment freezing arrangement..
5. Post VRS period chaos would be in the industry- service will be greatly affected.
6. Post VRS- Retained employees will be put in to greater hardships like workload, unnecessary transfers etc.. There will not be any compensation for those who are going to serve continuously in the company.
7. Post based promotions will get reduced and affected.
8. VRS is the option given only during the time of privatization- Bringing the same now is against 37A and cabinet assurances.
9. VRS is against the culture of Industrial Relations as it is straightly addressing to the individuals bypassing unions/ recognized union.
10. BSNL Board alone can’t decide VRS as DOT is involved relating to pension- DOT’s specific approval ensuring acceptance of enhanced pension expenditure due to VRS is needed. The enhanced pension liability should be fully owned by DOT.
11. For VRS compensation BSNL should seek Bank loan and thereby entering into debt trap- unnecessary burden to the already sluggish financial downturn

12. It is against the contract between employers and employee making him to leave the job prematurely at the initiative of the employer. It is de-industrialization – that is unemployment of ‘hitherto employed’
13. 11A provision is already there in 37A for those individuals willing to go on VRS. This is Voluntary in real sense because it is employee initiative
14. 55iib draconian provision is already there to send an employee after 55 by giving 3 months notice, a way of CRS
15. Staff telephone ratio is well reduced from 110/1000 DELs to 3/1000 DELs in 15 years. Comparing private sector is awful / harmful.
16. It is detrimental to the growth and competitive nature of the company.
17. In order to avoid legal difficulties 25 N (retrenching some categories) and 25 O (Closure of unviable units) of ID Act 1947, notice to government, employer design VRS.
18. It may cause brain drain thereby affecting customer service, technical know how-denuding of talent inevitable- sending out skilled manpower through VRS will not help the industry to face stiff competition.
19. Once VRS is announced it is beyond the control of Trade Unions to stop individual employees opting VRS
20. VRS optees can’t be permitted to seek job in other PSUs.
21. VRS is setting way to disinvestment.
22. VRS will lead to more outsourcing and contracts- closing permanent posts and replacing staff by low paid contract labourers.










Why individual opt VRS?

1. Fear of uncertain future
2. Emerging in to safe “DOT pension regime”
3. Pressing financial needs and getting lump-sum compensation
4. Job nature dissatisfaction
5. Sickness / ill health
6. Dream of entering in to business/ some other lucrative jobs
7. Women employees for domestic responsibilities
8. Inherent and expecting fair returns

VRS employer objectives

1. To rationalize manpower in line with the current business scenario, shedding
surplus
2. Removing old unnecessary skill set- a way of job enrichment
3. To cut down cost and remain competitive in business

5. SC/ST reservation in NEPP and 5 years qualifying service in NEPP
6. Pension option to C/L regularized in BSNL on or after 01.10.2000 and full pension

Kolkata, April 18:
Itz Cash Card, the prepaid cash card company, and BSNL Calcutta Telephones have joined hands to provide the facility of paying telephone bills through SMS, according to a press release.
The facility will be available to Calcutta district customers of BSNL, covering the city and adjoining districts such as Howrah, Hooghly, Nadia, South and North 24 Parganas. Pre-paid cards of various denominations, ranging from Rs 250 to Rs 10,000, can be used for the service, the release added.

1. Final Examination Paper – I (Theory) on 26-04-2011 (Tuesday) 10.00 hrs to 13.00 hrs.
