Subject: Suggestions on various issues pertain to BSNL interest for appropriate decisions require to be taken by DOT, as well through perusing by DOT with Various other central Government Ministries.

Respected Sir,
Sir we takes an opportunity to place some important suggestions on various issues pertain to Upliftment of Government owned BSNL. As BSNL is the only Telecom PSU which is fulfilling all the social obligations for the citizens of India in Urban, Semi Urban, Rural, Hilly, Remote areas on behalf of the Government of India. The issues are as under.
(1)Review of printing of Telecom Directory & TAC which are only binding to BSNL and fulfilling the actual purpose in interest of users : - (CFA, CM,Enterprise, NB Pertain)
(1a) In this regard we suggest that similar to BSNL 197 customer inquiry service, with more effective & by round the clock operation it should be run by DOT for all the working connection provided by all the operators to fulfill the actual purpose by propionately dividing the expenditure amongst all the operators. Which will further helpful to save paper which are made from trees at the cost of environment.
As at present negative royally and payment based purchase related terms and conditions are taken into consideration for inviting publication of directory tenders. While earlier up to year 1998 the publisher were paying 18% to 20% royalty & free of charge directory to the department for providing to the customer.
For example, if the (Average)requirement in an SSA is approx. 1 lakh directories and the collected amount through advertisement is 1 crore than we are getting 20 lakhs Rupees and free directory.
While at present by comparing this we can conclude that we are loosing 19 lakhs of royalty and have to pay Rs. Approx. 30 Lakhs for 1 lakhs copies. Thus, straight away we are loosing 50 lakhs Rs. for one SSA per year / event. Hence collectively the loss will be in the tune of crores of rupees per annum to BSNL. It is also evident that quality of directory is not improved against the high cost.
(1b) In same way the horizon of TAC should be made operational for representing the grievances of all the customers irrespective of operators. To fulfill the actual purpose by propionately dividing the expenditure amongst all the operators.
This issue is important in interest of users for the Customers quarry pertain to all the operators, transparency, hence intervention of DOT is essential to materialize such issues.

(2) Lapses in implementation of guideline issued by BSNL in line of Hon’ble Supreme Court direction for applying industrial tariff of electricity: (NB Pertain)
As per the Hon’ble supreme court direction, BSNL H/Q issued letter no 3-29/EW-2002 dated 11/11/2002 addressed to all CGMs for application of industrial tariff for BSNL, all the field units were asked to take up the matter with State Electricity Boards, because presently after formation of BSNL we are paying commercial tariff which is 30% higher than industrial tariff and the amount saved can be in hundreds of crores of rupees.















In this regard H/Q, Circles are totally responsible to co-ordinate with the concerned SEBs. On the contrary no rigorous persuasion has been done by any of the authorities, which is a major expenditure area of BSNL. The letter is simply endorsed to District Management which is not competent enough to handle the issue and is biting dust at their offices.
This issue is lingering since long despite it is having hundred of crorres finical implication to BSNL , hence intervention of DOT is essential to materialize by perusing the matter with the Ministry of Power and there by ensuring uniform implementation on the part of all the State Government and concern BSNL Circle.

(3) Discrimination in granting permission for cable laying, and applying reinstate, monthly rent etc for BSNL: (NB Pertain)
It is learnt that all the state Governments / State Civic authorities are whimsically imposing the charges for BSNL-cable laying, reinstate and monthly rent etc. with their own interpretation and without any logic. Not only that but there is also Discrimination in granting permission for cable laying, and applying reinstate , monthly rent charge etc for BSNL and other private operators. This has severely affected the growth and revenue of BSNL-Landline network.
Hence intervention of DOT is essential to materialize by perusing the matter by approaching Urban development Ministry for applying reasonable rate (At par with government standard) as per the classification of town / city in line of “Indian telegraph act” is to be finalized, by ensuring uniform implementation on the part of all the State Government and concern BSNL Circle.

(4) Discrimination in handling the bonofied verification of BSNL customers: (VTM Pertain)
It is learnt that the growth of BSNL-Mobile is severely affected due to stringent & discrimination policy of VTM cell of DOT in regard to the in bonofied verification of BSNL customers compare to other Operators. This is to be reviewed by DOT and crosschecking mechanism is to introduce by the committee comprise of all the operators at all the Circle and DOT level and is to be uniformly implementation.

(5) Initiation and direction to all the Union & state Governments authorities including U/T PSUs for opting BSNL services:
As a part of concerning secrecy and national security necessary policy decision is to be made by taking up this issue with the O/o Hon’ble PM of India and the Ministry of union Home affairs, and necessary directions are to be given to all the Union & state Governments authorities including U/T PSUs for opting BSNL services.

(2) Charging IUC @60 paise from VSNL, RIL NLDO as per the Judgment of Honorable Supreme court.
(3) Non reconciliation of IOBAS bills As per BSNL H.Q. letter no.352-4/2005-regln dated 12-06-2006.

Respected sir,
Since long we are taking up the above subject issues, as all these need to be materialized in favor of BSNL looking to it’s gravity in tunes of thousands crorres when ever BSNL interest is concerned. Hence it is high time to concentrate on these by adopting time bound & result oriented mechanism. It is worth to mention that we are raising / chasing these issues with latest updating inputs & information, since dated: 21/08/2007 (as per 1j) and subsequently followed by series of correspondence (1a to 1j).
Presently this issue is under scrutiny for finalizing the implementation policy of imposing penalty in the line of Hon’ble TDST/ Hon’ble Supreme court. In our correspondence SNEA/Guj/09-10/08b09 dated: 15 /08 /2009 we have suggested all the possible aspect of interpretation & counting No of roamers, however it is more advisable to act / interpret as per legally tenable definition for prompt and effect materialization. Hence without further delay further guide line is to be issued for “Recovery of signaling link charges from CMSPs / UASL for National and International roaming” by BSNL-HQ-Regulation cell, to All the CGMs.














However in this guide line all the possible aspect of penalizing the various CMTS-SPs / UASL operators as per their respective gravity / act of violation, fraud, and misinformation in accordance with various clause are to be made applicable and uniform action is to be imposed on these CMTS-SPs / UASL operators. In this regard our findings and further suggestions for various actions are as under.
(1/i) It is evident that M/S Bharti (Airtel) is also using BSNL CCS-7 links for their roaming /international roaming (As mentioned in our correspondence at 1f). Despite they are submitting undertaking since 2005 that they are not using BSNL links. We believe that here M/S Bharti (Airtel) have committed more violation.
Despite using links M/S Bharti (Airtel) had submitted forged undertaking “that M/S Bharti (Airtel) is not using BSNL CCS-7 links for their roaming /international roaming customer”. Hence all other actions in respect of value added agreement clause 2.2.3.7 and 6.6 which can be taken by BSNL in accordance with law are to be taken very rigorously by perusing the case with Hon’ble Court, DOT, TRAI up to the extent of cancellation of their license for adopting deliberately massive fraud activities with Government owned BSNL.Apart form recovery of respective national & international roaming charges from the date of interconnect with applicable interest.
More over now onward for such all kind of major violations specific & separate drafts of undertakings are to be reviewed & finalized with covering all possible aspect of quantum of the violation & fraud and respective course of actions of penalty in terms of amount and law so that it can be tenable in any challenging circumstances.

(1/ii) For all other CMTS-SPs / UASL operators also all other actions in respect of value added agreement clause 2.2.3.7 and 6.6 which can be taken by BSNL in accordance with law are to be taken very rigorously by perusing the case with Hon’ble Court, DOT, TRAI up to the extent of cancellation of their license for adopting deliberately massive fraud activities with Government owned BSNL.
And the recovery of respective national & international roaming charges from the (retrospective) date of interconnect with applicable interest all other CMTS-SPs / UASL operators is to be ensured.

(1/iii) As cited at point (7) of Annexure-II vide letter of Regulation dated 07/12/2009 addressed to all CGMs, as per the value added agreement clause 2.2.3.7 and 6.6 the quantum of usage of BSNL signaling link by all other CMTS-SPs / UASL operators for handing over “SMS service or similar service” is also to be work out at an earliest followed by the necessary action to raise the bills for such usage from the date of interconnect with applicable interest.
Thus now onwards the services wise charge of using our BSNL CCS-7 for various services e.g. Voice calls, SMS, MMS, Data transfer etc is to be defined and implemented at an earliest along with providing necessary uniform software, procedure and any other essential assistance to the field units.

(1/iv) In line of agreement clause 2.2.3.6 all necessary courses of actions for ensuring CMTS-SPs / UASL operators connectivity with SSTP of BSNL is to be implemented at Level-I and Level-II Tax in time bound manner.
Thus now onwards it is to be made mandatory for all the CMTS-SPs/UASL operators for taking connectivity with BSNL SSTP at level-I & II TAX, where it exists within time bound period. If which so ever CMTS-SP/UASL are not following or failing in doing so then various facilities extended to them e.g. opening of new MSC codes, new CCS-7 Signaling point code, augmentation of e1 for their requirement, must be held-up, till they fail to follow this term.
(1/v) For independent and regular monitoring and there by raising the bills data storage for signaling link data is to be provided at SSTP of level-I & II Tax.













Hence it is suggested that Data storage device of sufficient capacity is to establish at all the SSTP/TAX. Till that SSTP Bangalore / Vendor will ensure to provide data regularly to all the concern field units.
Subsequent to that for process of such retrieved data at SSTP of level-I & II Tax the finally considered software develop by vendor is to be provided to all the concern field units for once again it’s cross verification by all the possible means by their own and accordingly the finalized authenticated uniform software is to be provided to field units. Thus now onward all such data is to be processed in-house to avoid any revenue leakage.
(2)At the same time in connection of our above subject (2) and in light of the Hon’ble Supreme court judgment we request your good self to ensure the implementation of the instruction to all the Circle / SSA Heads to raise the supplementary bill to both, VSNL and RIL (@30 paise / min) for all the respective period.
(3) Non reconciliation of IOBAS bills As per BSNL H.Q. letter no.352-4/2005-regln dated 12th June 2006.
As per BSNL H.Q. letter no.352-4/2005-regln dated 12th June 2006.”The bills issued by BSNL based on bulk record shall be final. In case of difference up to +/-0.25% with the billing record of UASL, the amount billed by BSNL shall be treated as final. If the difference is more than +/- 0.25% but up to +/- 2% payment shall be made by UASL. However, reconciliation of variance shall be carried out by both parties and will be subject to dispute resolution mechanism. Variance beyond this limit also shall be subject to dispute resolution mechanism as specified in the Interconnect Agreement. “However, UASL shall pay to BSNL, the undisputed amount plus 50% of the disputed amount subject to a minimum of an amount equal to previous month’s billed amount immediately.”
On study of this issue pertain to bill raised under IOBAS by our Gujarat-Circle to all the concern operators, accordingly as per the status of recovery made and outstanding it appears that the provisions of BSNL H.Q. letter no.352-4/2005-regln dated 12th June 2006 have not been applied for the recovery of outstanding bills form 01.07.2005 to till date by the majority field units.
For all these above mentioned issues the necessary counseling and regular monitoring from BSNL-HQ to All the respective CGMs in a terms of operators / service providers wise monthly statement for month / event wise raising the bills & recovery made by respective CGMs is to be strictly established to ensure in time recovery & outstanding against all these bills.
In case of failure of concern Circle level authority necessary actions are to be taken. And in case of failure of concern operators / service providers in paying these regular / supplementary bills, the competent authority is advised to act in line of violation of the agreement in accordance with Law.
It is worth to mention that according to the gravity of all the above mentioned (1), (2), & (3) issues, in time action part from all the concern is very much essential . Hence we request your good-self to bestow the personal attention in all these three issues in line of precise clause of the laid instruction / agreement. As all these issues are lingering since long as private operators are not responding to the BSNL,hence intervention of DOT is essential to materialize such issues.
