underr NEPP and he wiillll gett hiis second up grradattiion seven yearrs afftterr tthatt,, iin 2015.. Now,, due tto

c)) A Drriiverr rrecrruiitted iin DoT and diid nott gett any prromottiion iin BSNL unttiill he gott prromottiion tto a hiigherr
grrade postt afftterr 1--10--2004,, say iin 2006,, wiillll now gett hiis ffiirrstt up grradattiion on 1--10--2004 and hiis

optted fforr OTBP//BCR//ACP earrlliierr and now ffiinds tthatt NEPP iis beneffiiciiall fforr hiim,, he can rre--optt fforr
NEPP. Therre arre some such sttrray cases and they can change theiir optiion now, beforre 27--10--
2011..

c)) The LDC TAs werre converrtted tto TOA on 1--7--2004 and ttheiirr pay was ffiixed underr FR 22((1))((a))((2))..
They became Srr TOA in 2007.. BSNLEU demanded tthatt siince tthey diid nott compllete 4 yearrs iin
tthe same scalle iin BSNL befforre orr afftterr pllacementt iin TOA scalle,, tthey shoulld be giiven ffiirrstt up
grradattiion on compllettiion off 4 yearrs serrviice iin Srr TOA scalle was nott acceptted by tthe managementt
on the grround tthat ttheirr pay scale was upgrraded ttwiice,, ffirrstt on up gradatiion as TOA and nextt on
up grradattiion as Srr TOA.. Howeverr tthey can now optt fforr fforrgoiing tthe TOA converrsiion tthey gott on
1--7--2004 underr FR 22((1))((a))((2)) iin orrderr tto gett ttheiirr ffiirrstt NEPP on 1--10--2004 tto tthe same scalle
witth tthe beneffiitt off FR 22((1))((a))(1),, iiff iit iis benefficiall ffor tthem(IIn mostt of tthe cases iitt willll be
beneffiiciiall fforr tthem)).. Theiirr Srr.. TOA prromottiion iin 2007 wiillll be ttheiirr second upgrradattiion.. Such an
