Sub: Memorandum listing out extraordinary reasons for expeditious en masse repatriation of ITS from BSNL/MTNL-reg.
Respected Sir,
At the very outset, while expressing our profound gratitude to you in reinitiating the process of absorption of ITS which has been lying in frozen state for the last over six years and adversely impacted the growth of BSNL/MTNL, we want to reiterate that the decision of BSNL/MTNL managements to repatriate non optee ITS in phased manner is not only unwarranted but is proving to be extremely counterproductive from the point of view of giving critically needed push to BSNL/MTNL.
While there is immediate necessity of ending duality of management that BSNL/MTNL has unfortunately been living with for the last more than a decade, complete lack of proactive stand of and diffidence on the part of BSNL/MTNL managements to act in the direction of smoothly and expeditiously facilitating the process of absorption has compounded matters and worsened the situation.
While both the managements ought to have been aggressively and pragmatically working out strategies and putting in place plans of action to replace the functions of already repatriated officers by absorbed Group – ‘A’ officers to start the process of building alternate management structure, it is unfortunate that the managements are very keen to protect the interests of ITS more than anything else. Viability and growth of BSNL/MTNL commands least priority in their scheme of things. This is exhibited by the fact that repatriated officers are being specifically asked to hand over charge to deputationists only, totally ignoring available absorbed Group-‘A’ (ITS) officers.
Comprehensive and viable blue print submitted by us to deal with the situation is not even under consideration of the managements, let alone acting on it. Good number of absorbed SAG officers (ITS) could have been asked to take over as heads of circles to facilitate the process besides addressing key issues of growth. Let alone taking on the issues of growth of services, CGMs are leaving no stone unturned to sabotage growth in every possible manner in order to justify their loud albeit hollow and baseless claim that repatriation of ITS is going to paralyze BSNL/MTNL.
Phased manner repatriation has plunged BSNL/MTNL in deeper crisis because of uncertainty it has resulted in and this is day by day adversely affecting growth of services at a time when all out efforts should have been going to bolster growth. This is causing great concern necessitating intervention on war footing basis to end the prevailing uncertainty by immediately repatriating all the non optees and working seriously and honestly towards implementation of contingency plan submitted by us on short term basis and building foolproof management structure of the company as a permanent measure.
BSNL/MTNL prestigious and strategic state owned telecom companies of the government have played unique and unprecedented role in meeting social obligations of the government in terms of providing universal telecom services at affordable prices. The role of both these companies has been unmatched and unparalleled as far as protecting the interests of users of telecom vis-a-vis their being exploited and fleeced by private operators is concerned. Both these companies even though having incurred incredible losses have in accordance to envisaged provisions of policy met roll out obligations.
BSNL, having made incredibly huge investments without returns in rural areas, has had an unparalleled and spectacular contribution in reaching out remotest parts of the country to provide telecom services at affordable prices to the downtrodden and underprivileged strata of the society. Private operators have not even remotely so far nor are in future going to play this role. They have instead violated one policy after another with impunity and in the process thus inflicted irreparable and huge damage on the growth of both these Companies. Besides, both these Companies have enabled government to effectively and successfully implement and leverage telecom policies from time to time.
Strength of both BSNL/MTNL, we are confident, weighs heavily with telecom policy makers and the government. Under no circumstances would the government allow and want its own companies to weaken day by day, we are sure. Seen in this context, immediate repatriation of non optee ITS from BSNL/MTNL to end huge uncertainty created as a consequence of phased repatriation and consequent crisis that has deeply engulfed both these companies should be utmost priority of the government.
It is understood that now both the managements are working out mechanisms for re induction of ITS in BSNL/MTNL under so called provisions of rule 37 after submitting technical resignation and getting full terminal benefits including pension from DOT. Their existing seniority and pay is being sought to be fully protected through hitherto hidden and new found out provisions of rule 37. The move of the managements and godfathers of ITS in DOT to discriminate against officers already absorbed under provisions of rule 37 A in such a blatant manner deserves strongest condemnation. Needless to say, such manipulations in blatant violation and disregard of principles of natural justice to inflict huge injustice on those who obeyed orders of the government will never stand legal scrutiny. Manipulators in DOT are bound to be exposed in due course of time because of their narrow considerations.
We would, therefore, make a dispassionate and fervent appeal to you, sir, and through you to the government to take imminent steps and actions to culminate the absorption process as quickly as possible by en masse repatriation of non optee ITS whose continuance is doing more harm than good. We also make an impassioned and just appeal to you, sir, that under no circumstances should DOT submit to the calculated game plan of managements of BSNL/MTNL colluded by godfathers of ITS in DOT to inflict irreparable damage on both the absorbed officers as well as BSNL/MTNL by re inducting ITS into BSNL/MTNL through backdoor means in utter violation of principles of natural justice.
