25.11.2011: DIrector(HR) writes to Jt. Secy(T), DoT regarding clarification on senority of Govt. servant on appointment in BSNL through technical resignation -<
(i) ITS officers on technical resignation get full govt. pension & all other retirement benefits.
(ii) Get full salary in the form of pay protection on their so called fabricated diabolical recruitment in BSNL including for the service rendered in DOT
(iii) Maintain their UPSC seniority even after resignation from DOT and fresh recruitment in BSNL.
ITS dominated BSNL Management game plan is exposed in the above communication made by BSNL Management to DoT to take back ITS Offciers under different absorption conditions. About 4.5 lakhs Group-'A', 'B', 'C' and 'D' employees were absorbed from DoT to BSNL w.e.f. 01.10.200 with Pension Rule 37(a). The fact remains that majority of the Group-'A' officers belonging to Telecom/Finance/Accounts, Telecom Civil/ Electrical/ Arch./TF Engineering Wings took absorption in BSNL/MTNL but the majority of ITS Offciers don't excersie option in favour of BSNL/MTNL on one pretext or the other. It is understood that as per the Govt. policy; a Govt. deptt. converted to PSU can't have two type of absorption conditions with different pension rules.
ITS Officers in a calculated way defeated the process of absorption of Group-'A' officers in BSNL/MTNL & now along ITS entry in BSNL/MTNL through backdoor. It will pave the way to litigations, which will further adversely affect the viability of BSNL.
BSNL/MTNL excutives, non-excutives are devoted & fully committed for the growth of both the companies. The survival of the compnies, is the survival of its employees bread. BSNL/MTNL Managent should entrust the responsibility to its committed work force rather than the ITS officers, who dis-own absorption in BSNL/MTNL.

25.11.2011:GS, President met Sr. GM(Pers.) & requested to fill up DGMs, DEs/SDEs vacant posts immediately. Sr. GM(Pers.) informed that competent authority has advised to issue promotion order from DE to DGM [about 20 cases] of un-disputed seniority . Promotion order will be issued shortly. We pleaded that in view of the immediate requirement of the BSNL about all DGM posts should immediately be filled up by the eligible DEs (Regular). Sr. GM(Pers.) assured to look into.
25.11.2011:JTO(Offg.) Court Case in Hon'ble Chandigarh High Court: The Case was heard yesterday and now the case is posted for hearing on 09th Feb'2012.
24.11.2011: Unjustified Dies-non order of 22 Executives of Bihar Circle are Cancelled: Prompt action of United Forum of BSNL Executive Association [SNEA+AIBSNLEA+AIGETOA] BIHAR CIRCLE wherein the dies-non order of 22 Executives of Mobile Unit was cancelled today (which was issued today morning by Sh. K.N.Rai, DGM (ITS) ) and explanation called by CGMT Bihar Circle from Sh. K.N.Rai DGM(MS-Admin) ITS regarding without permission of competent authority how he can lodge FIR against the leaders of UF of BSNLEA and asked to give the reply with a copy of FIR on 25.11.2011.
More than 300 Executives of SNEA+AIBSNLEA+AIGETOA gathered in CGMT Office Campus from 16.00 Hrs and sit on DHARNA for more than 5 hrs i.e. upto 21.30 Hrs and ultimately they got success. We appreciate their unity & strength.

24.11.2011:AIBSNLEA, SNEA(I) and AIGETOA CHQ Office bearers met and discussed the ongoing situation in BSNL wherein DoT order of repatriation is not being implemented in its true spirit and the efforts are being made by BSNL Management to bring back ITS Officers through back door entry at DGM/GM/CGM level, ignoring the interest of absorbed Group -'A' & 'B' level executives. It will not only harm the career prospects of BSNL executives but also will adversely affect the viability of BSNL/MTNL since these officers after taking full retirement and pension benefit will join BSNL and will not have any fear of Vigilance cases and Pension etc. After detailed discussions, the GS & President, AIGETOA agreed to join United Forum of BSNL Executives Association for opposing the outside/lateral entry at MT/DGM/GM/CGM grades. It will certainly strengthen our struggle in the days to come to save BSNL and its executives.

24.11.2011:Meeting with Addl. Secy(T) and Jt. Secy(T), DoT :GS. President AIBSNLEA, AGSs of SNEA(I) and CS TEAM (MTNL) met Addl. Secy(T) & Jt. Secy(T) and expressed our serious concern against phased repatriation of deputationists from BSNL/MTNL and discussed the contingency Plan submitted by United Forum wherein we explained that BSNL/MTNL are having sufficient absorbed Group-'A' level executives i.e. DGMs/GMs/CGMs to man the services and their growth.
We opposed back door entry of ITS Officers in BSNL/MTNL and requested that DoT should implement its repatriation order in true sense and should not allow back door entry to ITS in BSNL under different Pension Rule since many Group-'A' officers have already taken absorption in BSNL/MTNL with certain Pension Rule. BSNL/MTNL Managements should entrust the responsibility to their own executives rather than depending on those who don't want to shoulder the responsibility by taking absorption. We pleaded that BSNL/MTNL Managements should immediately be directed first to fill up the vacant HAG/SAG/JAG equivalent posts by conducting immediate DPCs since eligible executives are available. AST/JST appreciated our concern and assured to apprise Secy(T). However, they mentioned that we should regularly meet CMD/Director(HR), BSNL for immediate holding of DPCs.
24.11.2011:Meeting with Sr. GM(Pers.), BSNL:GS, President, AGS(HQ) met Sr. GM(Pers.) and discussed about holding of DPCs from DE to DGM, DE(adhoc) to DE(Regular), SDE(T) to DE(Adhoc), JTO to SDE(T) etc. Sr. GM(Pers.) after detail discussions on the status of pending legal cases directed AGM(DPC) to issue reminder to CGMs for sending of screening report/ACRs for SDE(T) to DE(Adhoc) promotion and to initiate DPC from DE(Adhoc) to DE(Regular) etc.
24.11.2011:Meeting With Director (HR), BSNL:President AIBSNLEA & GS, AGSs SNEA(I) met Director (HR) and expressed serious concern against non-filling up of HAG/SAG/JAG/STS/Group -'B' equivalent posts by its own eligible executives but the management is more concern to bring back the ITS Officers in BSNL by framing RRs of DGMs/GMs/CGMs. Director (HR) mentioned that some legal cases are pending in TES Group-'B' seniority. We explained that BSNL Management based on legal opinion can conduct DPCs in this emergent situation. Director(HR) assured an early action in this regard and also mentioned that repatriation issue will be resolved within three months time.
(b) Victimization of Executives of Bihar Circle: We strongly protested against the vindictive attitude of Sh. K.N. Rai, (ITS) DGM(Mobile), Bihar Circle for making dies-non order of 22-Executives of Mobile Unit. We requested Director(HR) for kind intervention so that further situation is controlled. Director(HR) assured to look into the matter.

THIS ASSOCIATION HAS ALREADY DEMANDED WITH THE CMD BSNL TO IMPLEMENT REGULARISATION OF ALL QUALIFIED/ OFFICIATING JTOs IMMEDIATELY AND PROCESS THE LICE TO JTO THEREAFTER WITHOUT MAKING THE ISSUE MORE COMPLICATED.
21.11.2011: DHARNA on 22nd Nov.'2011: BSNL/MTNL Management has stopped repatriation of non-optee ITS Officers ignoring DoT repatriation order dated 03.11.2011. Also convinced DoT administration to retain them for next 4-5 months and during this period RRs of DGM/GM/CGM are being framed arbitrarily in such way that so these non-optee ITS Officers continue in BSNL/MTNL through back door entry.
BSNL/MTNL has sufficient absorbed Group 'A' HAG/SAG/JAG level executives to maintain the telecom operations of BSNL/MTNL but BSNL/MTNL Managements are not at all interested to entrust the responsibility to these absorbed executives, they are only interested to continue with these ITS Officers who are not at all willing to get absorbed in BSNL.
To protest against such unethical & conspired approach of BSNL/MTNL Managements, United Forum of BSNL/MTNL Executives Associations Call for DHARNA on 22nd Nov'2011 this has to be very successfully implemented. The future course of action programme plans will be communicated shortly.
All the CHQ Office Bearers, Circle / Branch Secretaries are requested to mobilize the members for active participation in DHARNA on 22nd Nov'2011.
21.11.2011: It is reliably learned that Management Committee of BSNL has approved E1 + 5 increments for the JTOs. who have joined BSNL after 1.1.2007 paving the way for settlement of pay anomaly for JTOs of 2007, 2008 batch. This is as per the proposal given by this association at all front and now the said proposal is sent to BSNL Board for final approval.

A petition filed by the ITS Association against their repatriation from BSNL has been dismissed by the Delhi High Court. The ITS Association has stated in their petition that the terms and conditions for the repatriation are discriminatory. Cabinet opens doors for 51% FDI in multi-brand retail
Foreign investment limit in single-brand retail raised to 100%
Amidst high political drama, the Cabinet finally paved the way for the entry of global retail giants into India.
On a day of big-ticket reforms, the Cabinet cleared the way for multi-brand giants such as Wal-Mart, Tesco and Carrefour to open independent multi-brand retail outlets in the country.
Foreign direct investment (FDI) of up to 51 per cent has been allowed in multi-brand retail. Simultaneously, the Cabinet also gave the nod for upping the FDI limit in single-brand retail ventures to 100 per cent.
The Government had in February 2006 permitted 51 per cent FDI in single-brand retail.
The policy will allow multi-brand foreign retailers to set up shop only in cities with a population of more than 10 lakh as per the 2011 Census. There are 55 such cities. It means big retail chains can move beyond the metros to smaller cities.
Many conditions
The clearance comes with several riders. Foreign investors will be required to put up 50 per cent of total FDI in back-end infrastructure. Such infrastructure will include capital expenditure on all activities, excluding that on front-end units. Expenditure on land cost and rentals will not be counted for purpose of back-end infrastructure.
Retailers will need to source at least 30 per cent of manufactured/processed products from small industries. However, there will not be any obligation on the part of retailers to source agricultural produce such as fruit and vegetables.
It is being assumed that it would make eminent commercial sense for the retailers to source fresh produce locally. It is unlikely that retailers would undertake large-scale imports of agricultural products.
The Government has also retained the first right on sourcing agricultural produce. It is proposed to allow self-certification by the company with regard to the 50 per cent spend on back-end infrastructure, but with the condition that the Government could go in for surprise checks. In terms of single-brand retail, just one important condition has been added to the existing one. It makes 30 per cent sourcing from small and medium enterprises mandatory, as soon as the FDI limit exceeds 51 percent.
Multiple benefits
The Government believes opening up of FDI in multi-brand retail trade and further liberalisation of single-brand retail trade will facilitate greater FDI inflows besides additional and quality employment.
It will also bring a lot of benefits to the consumers and farmers in terms of quality, price and removal of inefficiencies in the agricultural sector.
